Colorado, held at the County Administration Building in Glenwood Springs on the 7th day of
December, 2020, there were present:

RESOLUTION NO. '2.0'2-1 -OS
A RESOLUTION CONCERNED WITH VACATING PORTIONS OF A PUBLIC ROAD
RIGHT-OF-WAY OTHERWISE KNOWN AS PORTIONS OF COUNTY ROAD 119,
ACCEPTANCE OF A PORTION OF NEW PUBLIC ROAD RIGHT-OF-WAY FOR COUNTY
ROAD 119, VACATING AN UNUSED RIGHT-OF-WAY FOR A PORTION OF COUNTY
ROAD 114, AND VACATING PUBLIC ROAD RIGHT-OF-WAY AND EASEMENTS
ASSOCIATED WITH THE LAKE SPRINGS RANCH PUD, FILINGS I AND 2.
A. Garfield County is a legal and political subdivision of the State of Colorado for which the
Board of County Commissioners ("BOCC") is authorized to act.
B. Berkley Family Limited Partnership ("Applicant'') is the owner of Lake Springs Ranch
PUD as more particularly described in Warranty Deeds recorded as Reception Nos.
405633 and 462134 and Quit Claim Deeds recorded at Reception Nos. 828751 and 828748
in the records of the Garfield County Clerk and Recorder and as further described in
Resolution No. 2016-35 approving a Preliminary Plan Amendment and PUD Amendment
including Filing 1 -6 of the Lake Springs Ranch PUD (the "Subdivision").
C. The BOCC has received a request to vacate a portion of dedicated public road right-of-way
of County Road 119 and to dedicate a new public road right-of-way for a portion of County
Road 119, as such right-of-way adjustments are consistent with the vacation of the Final
Plats for Filings 1 and 2 of the Lake Springs Ranch PUD.
D. The vacated public road right-of-way for County Road 119 is no longer needed and is being
replaced by acceptable alternative right-of-way.

E. The BOCC has received a request to vacate a portion of deeded, unused public road right-
of-way associated with a portion of County Road 114.
F. The vacated public road right-of-way for County Road 114 is no longer needed and is being
replaced by an acceptable alternative easement for the current alignment of County Road
114.
G. The BOCC has received a request to vacate public road dedications and easements within
the Lake Springs Ranch PUD, Filings 1 and 2, associated with the vacation of the Final
Plats for Filings 1 and 2.
H. The vacated public road dedications and easements are no longer needed as the Final Plats,
Filings 1 and 2 are being vacated and those Filings will no longer be developed; and
I. The above vacations and dedications are shown and further described in the Lake Springs
Ranch PUD ROW site plan attached as Exhibit A.
J. The BOCC is entitled to vacate a public road right-of-way and public road dedications by
resolution pursuant to the provisions of§ 43-2-303(l)(b), C.R.S., as amended.
K. The Applicant proposed dedication of acceptable alternative right-of-way and easements
for portions of County Road 119 and portions of County Road 114 and the BOCC is entitled
to accept roads over private lands which are properly dedicated to the public for use by the
public and on behalf of the public pursuant to the provisions of Section 43-2-20l(l)(a),
C.R.S., as amended.
L. To the extent necessary, a duly noticed public hearing was conducted by the BOCC
concerning the need and appropriateness of vacating said public road right-of-ways and
public road dedications, under the provisions of§ 43-2-303(2)(b ), C.R.S., as amended and
the Garfield County Land Use and Development Code of2013 ("LUDC)", as amended.
M. The Board of County Commissioners opened a public hearing on the 7th day of December,
2020 for consideration of whether the roadway vacations should be approved, approved
with conditions or denied, during which hearing the public and interested persons were
given the opportunity to express their opinions regarding the request.
N. The Board of County Commissioners closed the public hearing on the 7th day of December,
2020 to make a final decision.
0. The Board on the basis of substantial competent evidence produced at the aforementioned
hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the Board of
County Commissioners.

2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted or could be
submitted and that all interested parties were heard at that hearing.
3. That for the above stated and other reasons, approval of the Right-of-Way Vacation
requests as described herein are in the best interest of the health, safety, and welfare of
the citizens of Garfield County.
4. That the Right-of-Way Vacation requests are in general conformance with the Right-
of-Way Vacation Review Criteria contained in Section 4-1 0S(C) of the Garfield County
Land Use and Development Code, as amended.
5. That the determination of general conformance with the Garfield County Land Use and
Development Code as amended is based on the Applicant's representations in their
Application submittals and at the public hearing before the Board of County
Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County, State of Colorado, as follows:
1. The BOCC hereby approves the vacation of portions of public road right-of-way
for County Road 119 and 114, as further set forth in Exhibits B (County Road 119 easement
vacation) and Exhibit C (Vacation Plat 1926 Garfield County Road.
2. The BOCC hereby accepts the County Road 119 Right-of-Way Easement Map for
a portion of new alternative right-of-way for County Road 119, as set forth in Exhibit D. The
acceptance by this Resolution is limited to the descriptions contained in the County Road 119
Right-of-Way Easement Map.
3. The BOCC hereby accepts the Easement Deed for a portion of the existing
alignment of County Road 114, as set forth in Exhibit E. The acceptance by this Resolution is
limited to the descriptions contained in the Deed.
4. The BOCC hereby approves the vacation of public road dedications and easements
associated with vacation of the Final Plats for Filings 1 and 2 of the Lake Springs Ranch PUD as
set forth in Exhibit F (Filing 1 Vacations) and Exhibit G (Filing 2 Vacations).
5. The BOCC hereby approves the final configuration of right-of-way and easements
as further shown and described on The Vacation Plat of Lake Springs Ranch PUD Filings 1 and
2 attached as Exhibit H recorded in records of the Garfield County Clerk and Recorder as
Reception No. q5DhZ 3 •
6. The BOCC approvals outlined above are subject to the following conditions of
approval:

a. That all representations made by the Applicant in the Application shall be
conditions of approval unless specifically altered by the conditions of approval
contained herein.
b. That the Applicant, the County or whomever may propose construction of the
realigned County Road 119, shall obtain all required permits and approvals from
the County Road and Bridge Department for the future realignment of County Road
119 prior to initiation of construction.
c. That the final documentation and resolutions for the right-of-way vacations shall
include provisions reviewed and approved by the County Attorney's Office that
ensure that the existing prescriptive right-of-way for County Road 119 shall remain
in effect and in place until such time as the realigned County Road 119 is
constructed and accepted by the BOCC. The realigned County Road 119 is a
county roadway unless otherwise determined by the BOCC.
d. All vacation and dedication documents including the Vacation Plat shall be subject
to final review and approval by the County Attorney's Office for format including,
but not limited to, all plat certificates, the ownership and dedication certificate, plat
notes describing the purpose of the vacation plat, the dedication of the new right-
of-way for County Road 119 and a plat note clarifying the timing for conversion
from the prescriptive right-of-way to the new right-of-way.
e. The existing prescriptive right-of-way for County Road 119 shall remain in effect
and iI.1 place until such time as the realigned County Road 119 is constructed and
accepted by the BOCC. Said acceptance shall be documented by a Resolution of
the BOCC and considered at a public meeting where evidence regarding the
construction and acceptance of a newly constructed road alignment shall be
considered by the BOCC. The Resolution shall document the BOCC acceptance
of the roadway and shall also document that the previously approved vacation of
the prescriptive right-of-way for County Road 119 shall become effective at that
time, and that the Road and Bridge records for County Road 119 shall be updated
according! y.
7. The vacation of a portion of County Roads 119 and 114 as contemplated herein, shall
vest title in the adjoining property owner on the effective date of this Resolution.
8. The foregoing vacation, when effective, will not leave any property adjoining said public
road right-of-way without an established public road connecting said land with another established
public road.
9. To the extent necessary, the public road right-of-way vacated pursuant to this Resolution
shall contain a reservation for the continued use of all existing sewer, gas, water, ditch, canal,
electric, telephone or other utility purposes. Neither the requesting party nor the County are aware
of any such existing utility lines or similar appurtenances.
