RE: Lake Spring Ranch Completeness Review, PUD Amendment, Preliminary Plan
and Associated Rezoning
Dear Tim:
Thanks for already addressing some technical completeness items noted by Staff and
for meeting with us to discuss other completeness topics and clarifying a number of
concerns. Based on that meeting and further review of the three Lake Springs Ranch
associated applications we have made the following determinations regarding
completeness.
The Application for Rezoning to Rural for that portion of the properties being removed
from the PUD has been found to be complete. This is in part due to the concurrent PUD
submittals and inclusion of a rezoning justification report in the concurrent submittals.
The Applications for PUD Amendment and Preliminary Plat have been determined to
require additional submittals to address the items outlined below. The completeness
review has included input from the County Attorney’s Office.
1. Title Commitments for the three properties need to be updated.
2. Statements of authority for the three properties need to be updated and current
within a year. The County Attorney’s Office has confirmed the need for the
updates.
3. Mineral notice clarifications and correction to the mineral notice letter and
research form are needed. Separate mineral notice research forms for each
property need to be provided. We understand that much of the background
research is overlapping between properties.

4. An Application supplement needs to be provided to address the need for an
Impact Report. This may be addressed through reference to existing exhibits or
appendices included in the current submittal.
Once the above information is addressed, we can finalize our completeness review and
initiate our referral process and discussion of future scheduling of public hearings.
Additional Topic/Consideration
Separate from the above completeness items we wanted to acknowledge your detailed
Water Rights Summary (Exhibit 13), Water Supply Report (Exhibit 14) and Engineering
Utility Report (Exhibit 15) as key considerations. Staff anticipates utilizing our
consulting civil engineer and hiring a consulting water engineer to review your
submittals including issues of aquifer sustainability. Additional information may be
requested during the review/referral process based on their review. Some initial
comments include the benefits of clarification on the status of your consultant’s
recommendation for a joint monitoring program, additional discussion of well recovery,
and providing engineer’s stamps on their reports.
Please note that the Garfield County Land Use and Development Code requires that the
technical completeness issues be resolved within 60 days of the date of this letter,
unless a request for extension is submitted and approved.
Please feel free to contact me with any questions on the completeness topics noted
above and we apologize for the delays in finalizing the completeness review. We look
