RE: Hogback View Estates Administrative Review (File No. GAPA-10-24-9042\
Dear Doug,
This letter is sent to you as the authorized representative for the application GAPA 10-
24-9042, which requested an Administrative Land Use Change permit to allow a
lndustrial Fabrication Use (Metal Shop) for a waiver for Section 7-1001(A) to allow the
use in a platted residential subdivision exemption. The property is located at24 County
Road 138, New Castle CO, in Section 35, Township 5, Range 90. The Application has
been reviewed in accordance with the Administrative Review procedures contained in
the Land Use and Development Code as amended. Said provisions require a decision
by the Director of the Community Development Department on whether to approve,
approve with conditions, or deny the request.
The Director's Decision is hereby issued denying your Application with the following
findings:
1. That proper public notice was provided as required for the Director' s Decision.
2. Consideration of the application was extensive and complete, that all pertinent
facts, matters, and issues were submitted and that all interested parties were
given an opportunity to provide input prior to the Director's Decision.
3. That for the above stated and other reasons, the proposed Hogback View
Estates Metal Shop isn't in the best interest of the health, safety, convenience,
order, prosperity, and welfare of the citizens of Garfield County.
4. That the application has not adequately met the requirements of the Garfield
County's 2030 Comprehensive Plan and New Castle's 2011 Comprehensive
Plan.
5. That application has not adequately met the requirements of the Garfield County
Land Use and Development Code o12013, as amended, and waiver criteria
including but not limited to: Roadway standards per Section 7-107 Access and
Roadways, industrial use per Secfion 7-1001 (A) Residential Subdivisions and
existing unpermitted tmprovements to a permitted residential garage (electrical,
OWTS, insulation, and half bath).
The Land Use and Development Code requires notification to the Board of County
Commissioners for their review and potential call-up of the Director's Decision. The
Board review is for a period of 10 calendar days commencing on the date of the
Director's Decision. You may request the decision be called up to the Board during this
period. The call-up period shall expire on May 2nd. Once the call-up period has expired
and provided no requests for call-up have been received, the Director's Decision shall
be final. Please contact the Community Development Department if you have any
questions regarding the Director's Decision.
