DESCRIPTION OF SITE The properties are located approximately 3 miles south of Glenwood Springs on County Road 117 along the Four Mile Corridor. They are in the Glenwood Springs Area of Influence. The southern Parcel (No. 218534300010) is 3 acres, and the legal description is detailed in the deed at Reception No. 251777. The northern Parcel (No. 21853400011) is 3.85 acres, and the legal description is also detailed in the deed at Reception No. 251778. The property deeds described in the receptions are from 1971 before the subdivision regulations. During the review of the application, the applicant recorded a BLA between the 2 parcels. The BLA moved the property line to increase the northern parcel to 4 acres. Recorded documents for the BLA are Reception Nos. 1005265, 1005266, and 1005267. The properties are zoned Rural. The topography of the properties are flat with a 1-2% slope from north to south. Currently a well is located on the northern parcel to serve the single-family residence and irrigation. The amendment may facilitate a future minor subdivision application. The northern parcel may be subdivided into 2, 2 acres lots and 2 with another well to serve the potential additional lot. At this time the applicant has no plans to develop on the southern parcel or allow ADUs on the northern parcel. Figure 1 Location of Parcel II. DESCRIPTION OF PROPOSAL The applicant is requesting to change the Future Land Use Map designation on the parcels from Residential Medium to Residential Medium High. The applicant plans to do a future minor subdivision of 2 acres each on the northern parcel which would comply with the proposed designation of the Comprehensive Plan Future Land Use Map. A minor subdivision is an administrative review with a Director’s Decision. Surrounding parcels include Residential Medium, Residential Medium High and Residential High designations. The designation of Residential Medium is 6-10 acres/dwelling unit while Residential Medium High is 2-6 acres/dwelling unit. AUTHORITY – APPLICABLE REGULATIONS The process and standards required for amending the Comprehensive Plan 2030 are included in Chapter 4, Amending the Plan. This chapter lays out the process and standards for amending the Comprehensive Plan text and Future Land Use Map (FLUM). A response to the list of standards of approval is found in the application and staff has provided an evaluation of these criteria in the Staff Analysis section of this report. IV. REFERRAL AND PUBLIC COMMENTS According to Chapter 4 of the Comprehensive Plan, the County is required to refer applications to all municipalities within the county, counties bordering the county and any town/city within 3 miles of the county border along with the applicant doing noticing. Asked about the Comp Plan Amendment Process. 2. Garfield County Sheriff, Levy Burris: Doesn’t have issues or concerns. 3. Eagle County, Vince Hooper: No comments or concerns. 4. Town of Carbondale, Jared Barnes: No comments on the application. Asked about the Comp Plan Amendment Notification Process. Other agencies and jurisdictions included in the referral request and didn’t respond: Basalt, Carbonate, DeBeque, Glenwood Springs, Parachute, Rifle, Silt, Mesa County, Pitkin County, Rio Blanco County, Routt County, and Glenwood Springs Rural Fire Protection District. 6 Public Comments No comments were received. V. STAFF ANALYSIS AND CRITERIA The adopted Comprehensive Plan 2030 states that a Plan Amendment shall demonstrate that the proposed text or designation addresses errors in the Future Land Use Map (FLUM) or Comprehensive Plan or meets the following criteria. As the proposed amendment is not to address errors in the Plan, the application will need to meet the review criteria below: 1. The existing comprehensive plan and/or any related element there of are in need of the proposed amendment. The revised future land use map will provide more accurate designation due to the size of original parcels. Each parcel is under the 6-acre minimum of Residential Medium. 2. Strict adherence to the Plan would result in a situation that is either unintended or does not allow for consistency with other key elements and policies of the Plan. Strict adherence to the Future Land Use Map designation would result in a conflict between the existing size of the parcels and the FLUM. The parcels continue to be out of compliance since they are under 6 acres each. 3. The proposed FLUM amendment is compatible with surrounding area, and the vision, policies and strategies of the Plan. Properties are surrounded by a residential medium high-density subdivision and a residential high-density subdivision across the road. The residential medium high density adjacent subdivisions are Chelyn Acres, Sunlight View and Sunlight View II. All 3 subdivisions have between 30-50 parcels each of single-family residences with some with detached garages and accessory structures. Majority of the Chelyn Acres and Sunlight View subdivisions parcels are between 2-6 acres. A few parcels are between 6-10 acres. The high-density subdivision is Sunlight Parkway with 6 parcels with duplex homes on each parcel zoned PUD. All but 1 parcel will be less than 1 acre. Adjacent parcels in the medium density designation are between 2-3 acres each. The proposed FLUM designation is compatible with the surrounding area. 4. The proposed FLUM amendment will have no major negative impacts on transportation, services, and facilities. The proposed FLUM amendment will have no major negative impacts on transportation, services, and facilities. It will potentially allow one additional single-family residence. 7 5. The proposed FLUM amendment will have minimal effect on service provision, including adequacy or availability of facilities and services, and is compatible with existing and planned service provision. The proposed FLUM will have a minimal effect on service provisions existing and proposed will be served by wells and OWTS. 6. The proposed FLUM amendment will result in a logical and orderly development pattern and expansion of services and will not constitute spot zoning. The proposed FLUM will result in a logical and orderly development since it is adjacent to a subdivision designated as Residential Medium High. The majority of adjacent and other surrounding parcels are approximately 2-3 acres each. 7. The County or the general area in which the FLUM amendment is proposed has changed or is changing to such a degree that the amendment is in the public interest. The Four Mile Corridor is well established as a residential area. The proposed amendment is consistent with the surrounding uses and densities. 8. The proposed amendment has a significant public benefit; will promote the public welfare and will be consistent with the visions, policies and strategies of the Garfield County Comprehensive Plan and the elements thereof. The proposed amendment addresses a FLUM anomaly and allows a reasonable adjustment to bring existing parcels into compliance with FLUM designation. 9. The proposed designation on the FLUM is in compliance with the visions, policies and strategies of the Comprehensive Plan and any applicable intergovernmental agreement affecting land use or development. The proposed designation on the FLUM is in compliance because it does not increase the burden on resources, services and is consistent with surrounding uses and density. Recommended Findings 1. That proper public notice was provided as required for the hearing before the Planning Commission. 2. That the hearing before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were submitted or could be submitted and that all interested parties were heard at that meeting. 9 3. That for the proposed Future Land Use Map amendment to the Garfield County Comprehensive Plan is in the best interest of the health, safety and welfare of the citizens of Garfield County. 4. That the proposed Future Land Use Map amendment to the Garfield County Comprehensive Plan meets the Plan Amendment Standards for Approval contained in Chapter 4 of the Comprehensive Plan. Recommended Motions 1. Approve the request to change the FLUM for these parcels from Residential Medium to Residential Medium High. 2. The Planning Commission motion should include the following: a. Authorize the Chair to sign a Resolution thereby amending the Comprehensive Plan 2030; b. Authorize the Chair to sign the letters certifying the amendment to the BOCC, municipalities and the surrounding counties; and c.
