More described in reception no. 273384. PRACTICAL DESCRIPTION The property is located at 353 Stagecoach Lane which is approximately 2 miles northeast of Carbondale. It is approximately 17,860 SF in size and PID#: 239119400139. LOT SIZES 17,860 SF ZONING Planned Unit Development (PUD) I. DESCRIPTION OF SITE AND PROPOSAL The application involves the Ranch of Roaring Fork, Phase V, Lot 25 and the HOA easement. Juan Grobler purchased the property in 2004. The parcel was platted in 1976 as part of Ranch of Roaring Fork, Phase V, Lot 25 and recorded as Reception No. 273384. The proposed amended final plat is to reduce the utilities and drainage easement on the west side of the parcel from 20 foot to 8 foot. It would be similar to a 10-foot easement on the eastern side of Lots 12-14 at the cul de sac. Originally the applicant asked for 10-foot easement but with the permission of the HOA, was granted an allowance to have an 8- foot easement. Currently a fence is in the 20-foot easement but will be replaced by a sunroom. New exterior decks will be built but are not in the easement. 2 Figure 1 Location of Parcel II. AUTHORITY – APPLICABLE REGULATIONS This Amended Final Plat Application is being processed in accordance with Section 5- 305, Amended Final Plat and 4-103, Administrative Review of the Land Use and Development Code. An excerpt from Section 5-305 (C) containing the Review Criteria for an Amended Final Plat is provided below. 5-305 Amended Final Plat Review C. Review Criteria. An application for an Amended Final Plat shall meet the following criteria: 1. Does not increase the number of lots; and 2. Does not result in a major relocation of a road or add any new roads; or 3. Will correct technical errors such as surveying or drafting errors. 3 Figure 2 Proposed Amended Plat III. STAFF ANALYSIS Code Analysis Section 5-305 Amended Final Plat Review The application does not increase the number of lots. It does not relocate any roadways and will correct the surveyed plat with a reduced easement on the westside of the property. Applicant had the utilities marked. The utility lines are not affected by the original and proposed reduced easement. They are generally located inside the adjacent parcel owned by the HOA except for a portion is in the lower southwest corner of the lot within the easement remaining unchanged, near the road but in Lot 25. 4 Figure 3 Utility Lines Marks Figure 4 Improvement Location Certificate Map 5 Plat Details 1. Final review of the plat by the County Attorney’s office will be required including the title for the amended plat, edits to the purpose statement, plat notes and certificates, easement documentation, title certificates and lienholder certificates if applicable. 2. The Applicant has provided a Title Commitment for the property in support of their representation that there are no lienholders. 3. Final edits to the proposed plat shall be completed, reviewed, and accepted by the County including but not limited to: a. Add a certificate for Ranch of Roaring Fork HOA president to sign. b. Correct spelling of neighbor’s name on their parcel. c. Delete building footprint. 4. Provision of written agreement with the HOA for allowance of the 8-foot easement subject to final review by County Attorney’s Office. IV. REFERRAL AND PUBLIC COMMENTS Referral comments 1. Consulting Engineering, Chris Hale: Noted water and either cable, phone, and/or electric pedestal in the easement adjacent to the street. Applicant should verify with appropriate utility providers that no existing utilities run within the 20’ easement and if there is, be relocated into the proposed easement. Applicant should also verify that there are no drainage conveyances within the 20’ easement and that the proposed easement would be adequate to contain any drainage features. Public comments No public comments were received prior to the writing of this staff report. V. RECOMMENDED FINDINGS AND CONDITIONS Suggested Findings of Approval 1. That proper public notice was provided as required for the Director' s Decision. 2. Consideration of the application was extensive and complete, that all pertinent facts, matters, and issues were submitted and that all interested parties were given an opportunity to provide input prior to the Director's Decision. 3. That for the above stated and other reasons, the proposed Amended Final Plat of Lot 25, Ranch of Roaring Fork, Phase V is in the best interest of the health, safety, convenience, order, prosperity, and welfare of the citizens of Garfield County. 4. That the application is in general conformance with Garfield County’s Comprehensive Plan 2030, as amended. 6 5. That with the adoption of conditions the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. Staff recommends is for approval of the Amended Plat of Lot 25, Ranch of Roaring Fork, Phase V. Suggested Conditions of Approval 1. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Amended Final Plat of the Lot 25, Ranch of Roaring Fork, Phase V shall be subject to all applicable federal, state, and local laws. 3. Final edits to the Final Plat, including plat notes and title, shall be completed and then submitted to the County (including County Attorney, Surveyor, and Assessor offices) to be reviewed and accepted prior to execution and recording. Updated final plat shall be provided digitally for review prior to a mylar being prepared. The following edits are required, and language provided may be modified as warranted. a. Add a certificate for Ranch of Roaring Fork HOA president to sign. b. Correct spelling of neighbor’s name on their parcel. c. Delete building footprint. 4. Prior to execution and recording of the plat, provision of written agreement with the HOA for allowance of the 8-foot easement subject to final review and acceptance by County Attorney’s Office must be submitted. 5. Prior to execution and recording of the plat, provide confirmation from the HOA that there is no drainage improvements located in the area of the easement being reduced. 6. At the time of building permit, Applicant shall provide as part of the review, verify and update any utility’s locations. Civil and Environmental Consulting and Design RE: Review of the Ranch of Roaring Fork, Phase V, Lot 25, Amended Final Plat: FPAA-07-24-9027 Dear Heather: This office has performed a review of the documents provided for the Ranch of Roaring Fork, Phase V, Lot 25, Amended Final Plat application. The submittal was found to be thorough and well organized. The review generated the following comments: 1.The existing conditions survey shows water appurtenances and either a cable, phone, and/or electric pedestal in the easement adjacent to the street. The Applicant should verify with the appropriate utility providers that no existing utilities run within the 20' easement. If there are utilities in the easement the Applicant may have to relocate them into the 10' proposed easement with the permission of the impacted utility company. 2.No topography was provided to verify existing drainage patterns. The Applicant should verify that there are no drainage conveyances within the 20' easement. If there are, the Applicant should provide verification that they 10' easement would be an adequate width to contain any drainage features that might need to be relocated.
