PRACTICAL DESCRIPTION The property is located on County Road 260 which is approximately 2.5 miles northwest of Silt. It is approximately 117.56 acres in size and the Assessor Parcel Nos are 212735200085 and 212736200086. LOT SIZES 117.56 acres ZONING Rural I. DESCRIPTION OF SITE AND PROPOSAL The application involves Section 35, Township 5, Range 92 of Antlers Orchard Tracts 6, 7, 8, 9, 10A, 11B, 23B, 24 and Parcel B of the Amended Barrie Exemption Plat. Philip and Katheryn Barrie purchased parcel 212736200086 (Antlers Orchard Tracts) in 1990. The tracts were platted in 1909 as part of Antlers Orchard and recorded as Reception No. 37489. Parcel 212735200085 (Barrie Exemption) was also purchased in 1990. The warranty deed is recorded as Reception No. 414354. A quit claim deed correction was recorded as Reception No. 745080 in 2008. The Barries sold parcel A of the Barrie Exemption in 1990. An amended plat of the Antlers Orchard tracts and the Parcels of the Barrie Exemption was recorded in 2009 as Reception No. 779548. The proposed amended final plat is to adjust the interior property lot lines of the Antlers Orchard tracts and Parcel B to better address the irrigation ditch alignment access. It also addresses natural topography for better use of future agricultural and residential purposes compared to the current configuration of the square tracts originally platted. 2 Figure 1 Location of Parcel II. AUTHORITY – APPLICABLE REGULATIONS This Amended Final Plat Application is being processed in accordance with Section 5- 305, Amended Final Plat and 4-103, Administrative Review of the Land Use and Development Code. An excerpt from Section 5-305 (C) containing the Review Criteria for an Amended Final Plat is provided below. 5-305 Amended Final Plat Review C. Review Criteria. An application for an Amended Final Plat shall meet the following criteria: 1. Does not increase the number of lots; and 2. Does not result in a major relocation of a road or add any new roads; or 3. REFERRAL AND PUBLIC COMMENTS Referral comments 1. Consulting Engineering, Chris Hale: Noted that the plat proposed 10’ wide public land access through Tract 7 but the LUDC code for the right or way is 30’. The public land access easement was platted as a road over the edge of 2 lots in the 2009 plat. Also noted by consulting engineer, that the applicant should verify that the Farmers Irrigation Company and power company doesn’t have any issues with the proposed lot lines and easements. 2. Silt Water Conservancy District, Kevin Roberts and Charles Terrell: Farmers Irrigation Ditch has an exclusive right of way that includes a 50-foot easement on each side of the water ditch from the water’s edge. Easement isn’t allowed to be shared with any other entity or used as any type of access through the subdivision. The board accepts all ditch crossings. They do not require to be install the crossing at the time of the amended final plat approval. Ditch crossings will need to be engineered stamp drawings and installed when lots are sold and developed. 3. Colorado Geological Survey, Jill Carson: Noted that Tracts 6 and 8 are impacted by drainages and debris inundation hazards at or below the mouth of drainages. Advises that the 2 tracts shouldn’t be platted as proposed without an evaluation demonstrating that building sites exist outside of the areas exposed to erosion, slope instability, and debris inundation hazards. Calls out that plat note 22 doesn’t address geological hazards. Recommends a site-specific hazard investigation to delineate areas exposed to erosion, slope and debris inundation hazards and to revise plat to delineate lots with buildable areas that avoid geologic hazards. 4. Garfield County Assessor Office, Casey Lawrence: Noted that plat title should reflect the Antlers Orchard Tracts numbers and Barrie Subdivision Exemption. Also notice a bearing/distance closure error on survey that needs to be corrected before final approval. 5. Garfield County Road and Bridge, Wyatt Keesbery: Has no issues with proposed entrance location at the corner of CR 260 to make it 4-way intersection with the county road turning eastbound, a private road north and private road east into the Barrie parcel. 6. Department of Water Resources, Ailis Thyne: Courtesy review since property is not a subdivision. Reviewed the use of the current well. The well is allowed to be used for fire protection, ordinary household purposed for 2 single family dwellings, watering of poultry/domestic animals and irrigation of no more than ½ acre of home and garden. Public comments Parcel A of Barrie Subdivision Exemption Owner, Paul and Linda Butler: Concerned about the traffic along the westside of his property. Neighbor, Lauren Harutun: Has concerns regarding impacts on surrounding properties, property lines and adverse possessory rights. 7 IV. STAFF ANALYSIS Code Analysis Section 5-305 Amended Final Plat Review 5-305 (c) 1. The application does not increase the number of lots. All Antler Orchard tracts numbers will stay the same, but acreage is slightly changing from original tract numbers. 5-305 (c) 2. The application doesn’t result in major road relocations. Some roads will use existing platted areas while driveways will be aligned to existing topography. North view of proposed road along westside of Track 10A. Southeast view of possible entrance road south of pole. Currently the private road enters northbound from County Road 260 along the westside of Parcel A property. The proposed private road is to be moved around the west side of a mature cottonwood trees and enters Parcel B south of the pole and connects with existing road just south of the pond. 5-305 (c) 3. The application will correct any technical (surveying or drafting) errors. It will realign property lines to work with the existing topography. East view of pond on Parcel B. Southwest view on Track 11B looking at the pond. Originally the square tracts of Antlers Orchard property lines cross straight through the pond. With the lot line adjustments, the pond would stay on Parcel B of the Barrie 8 Subdivision Exemption for agricultural use. The current well and well house near the pond will serve the Parcel B portion of the Barrie Exemption Plat. Northwest view of highest point of Track 10A hill. North view of topography of Track 6 from Track 11B. The original plat didn’t account for the ditch and the hilly topography on the northeast portion of Track 6. The new proposed property lines for the tracks use the topography to create open space and access to future residential housing. The proposed plat also labels the 50-foot exclusive easement that Farmers Irrigation Ditch Co has owns since 1945. Plat Details and Additional Analysis Final review of the plat by the County Attorney’s office will be required including the title for the amended plat, edits to the purpose statement, plat notes and certificates, easement documentation, title certificates and lienholder certificates if applicable. The Applicant has provided a Title Commitment for the property in support of their representation that there are no lienholders. Final edits to the proposed plat shall be completed, reviewed, and accepted by the County. Some issues that need to be addresses is that correcting the tile of the Plat. It should read as Amended Final Plat of Tracts 6, 7, 8, 9, 10A, 11B, 23B, 24 of Antlers Orchard Development Company’s Plat No. 1 and Parcel B Barrie, Exemption. As noted in a referral, the bearing/distance closure error on survey must be corrected. A site-specific Geotech analysis on Track 6 and 8 will be required at the time of building permit. Staff also recommends adding building envelopes to Tracts 6 and 8 due to the topography, possible slope hazards and to avoid impacts of wetland on the southern portion of Track 6. Also, a plat note on that each lot will be subjected to Division of Water Resources policies and permitting requirements associated with pre-existing platted lots is required. Staff recommends that plat note 21 be that Applicant consults the Colorado Stage forest Service Firewise Construction guidelines or similar future guidelines for new construction and landscaping on the amended Tracks. The Farmers Irrigation Ditch created new issues in the 1st draft of the proposed plat. With the Farmers Irrigation Ditch Company not allowing their easement to be used as a road, the proposed road on the westside of the property will be eliminated. This includes the road crossing over the ditch. A plat note to install ditch crossings at the time of driveway construction. The engineered plans must be approved by Farms Irrigation Ditch 9 Company. It allows the crossings to be constructed at development time instead of the amending the plat phase. Grading permits will be required when driveway are constructed. The main entrance to majority of the tracks will be at County Road 260. It will create a 4-way stop with the county road, existing private road and proposed private road. The entrance will be a condition of approved by Road and Bridge. V. RECOMMENDED FINGINDS AND CONDITIONS Suggested Findings of Approval 1. That proper public notice was provided as required for the Director' s Decision. 2. Consideration of the application was extensive and complete, that all pertinent facts, matters, and issues were submitted and that all interested parties were given an opportunity to provide input prior to the Director's Decision. 3. That for the above stated and other reasons, the proposed Amended Final Plat of Antlers Orchard Tracts 6, 7, 8, 9, 10A, 11B, 23B, 24 and Parcel B of Barrie Subdivision Exemption is in the best interest of the health, safety, convenience, order, prosperity, and welfare of the citizens of Garfield County. 4. That the application is in general conformance with Garfield County’s Comprehensive Plan 2030, as amended. 5. That with the adoption of conditions the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended Suggested Conditions of Approval 1. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Amended Final Plat of the Antlers Orchard Tracts 6, 7, 8, 9, 10A, 11B, 23B, 24 and Parcel B of Barrie Subdivision Exemption shall be subject to all applicable federal, state, and local laws. 3. Final edits to the Final Plat, including plat notes and title, shall be completed and then submitted to the County (including County Attorney, Surveyor, and Assessor offices) to be reviewed and accepted prior to execution and recording. Updated final plat shall be provided digitally for review prior to a mylar being prepared. The following edits are required, and any language provided may be modified as warranted at time of final review. a. Correct the title of the plat b. Correct bearing/distance closure error on survey. c. Add plat note on install ditch crossings at time of driveway construction with engineered plans approved by Farmers Irrigation Ditch Company. d. Eliminate the road crossing over a portion of the ditch easement on the westside of the property. e. Grading permits required for driveway construction. 10 f. Include a require a geo-tech analysis at the time of building permit in plat note 22. g. Add building envelopes on Tracks 6 and 8 due to topography, possible slope hazards, and to avoid impacts of wetlands on Track 6. h. Add a plat note on future well permitting that each lot will be subjected to Division of Water Resources policies and permitting requirements associated with pre-existing platted lots. i. Create a 4-way stop at the entrance to the main road into the property at County Road 260 subject to approval by Road and Bridge. j. Add a plat note recommending the Applicant to consult the Colorado Stage Forest Service Firewise Construction guidelines or similar future guidelines for new construction and landscaping on the amended Tracts. The board does not have any issues with the planned ditch crossings for the Barrie Subdivision as long as they follow our process. I understand the applicant proposes “to adjust the interior property lines within the Applicants' overall property to coincide with the existing irrigation ditch, provide feasible access to each tract / parcel, work with the natural topography, and to ensure better use of the individual lands for future agricultural and residential purposes compared to the current blocky configuration.” The proposed plat amendment involves nine lots, tracts or parcels on approximately 122 acres. Proposed Tracts 6 and 8 are impacted by drainages and debris inundation hazards at or below the mouths of drainages (see attached figure showing the proposed plat relative to calculated slope angles derived from high-resolution LiDAR.) CGS strongly recommends a non-buildable setback from steep (>30%) slopes and drainage channels to reduce risk of damage caused by erosion, slumping, and construction-re lated instability. Allowable building sites should be located entirely outside of debris inundation hazard areas. It is not clear that a viable building site exists on proposed Tracts 6 and 8. These tracts should not be platted as proposed without an evaluation demonstrating that building sites exist outside of areas exposed to erosion, slope instability, and debris inundation hazards. The plat note discussed in Section 7-108 Use of Land Subject to Natural Hazards, in the Barrie Subdivision Amended Final Plat Application (Boundaries Unlimited Inc., April 16, 2024) is inadequate. Plat note 22 does not address geologic hazards. CGS recommends that the county require a site-specific hazard investigation to delineate areas exposed to erosion, slope, and debris inundation hazards, and the plat may need to be revised to delineate lots with buildable areas that avoid geologic hazards. I got a chance to look at the Barrie/AOD Amended Plat and it looks like my concern with the naming convention of the plat has been corrected, but they still haven’t corrected the Certificate of Dedication and ownership as it still reads: I think all references to “Barrie Subdivision” need to be removed from the plat since this is an amended plat and not a new subdivision. Otherwise it looks like the plat contains the same survey data as the draft that I reviewed and approved 9/11/2024, so once “Barrie Subdivision” is stricken from the plat this looks good to go to me. I don't even know if that is required. All things being equal, I'd like the Barrie's to get what they desire with as little infringement to current property owners as possible.
