RE: Re-lssuance of the Director's Decision Letter - Amended Final Plat for
Antlers Orchard Tracts 6, 7 , 8,9, 10A, 118, 23B, 24 and Parcel B of Barrie
Exemption. (F PAA-0 4-24-9021)
Dear Kathie, Phillip and Deric,
A Director's Decision letter was issued for the requested amended plat on
December 10, 2024. This re-issuance of the Decision Letter is necessary to
correct a condition of approval based on additional evidence provided by the Silt
Water Conservancy District - Farmers lrrigation Ditch Company.
This re-issued letter is sent to you as the owner/applicant and representative for
the Application for an Amended Plat for the Antlers Orchard Tracts 6,7,8,9, 10A,
118,23B.,24 and Parcel B of Barrie Exemption. The Application requested an
amendment to the plat to adjust the interior property lines for better access for
future development, agriculture and to align with existing topography. The
properties are located at on County Road 260 and known by Assessor's Parcel
No. 212735200085 and 212735200086. The Application has been reviewed in
accordance with the Administrative Review procedures contained in the Land Use
and Development Code as amended. Said provisions require a decision by the
Director of the Community Development Department on whether to approve,
approve with conditions, or deny the request.
The Director's Decision is hereby re-issued and corrects and replaces the original
letter dated 12110124. This letter is issued approving your Application with the
findings that the Applicant has completed all public notice requirements and that
subject to compliance with conditions of approval the Amended Final Plat of the
Antlers Orchard Tracts 6,7,8,9, 10A, 11B,23B,24 and Parcel B of Barrie
Exemption meets the requirements and standards of the Garfield County Land Use

and Development Code including the Amended Plat Review Criteria contained in
Section 5-305.
The Application is approved subject to the following conditions.
1. All representations of the Applicant contained in the Application submittals
shall be conditions of approval unless specifically amended or modified by
the conditions contained herein.
2. The Amended Final Plat of Antlers Orchard Tracts 6, 7, 8, 9, 10A, 11B,23B,
24 and Parcel B of Barrie Exemption shall be subject to all applicable
federal, state, and local laws.
3. Finaledits to the Final Plat, including plat notes and title, shall be completed
and then submitted to the County (including County Attorney, Surveyor, and
Assessor offices) to be reviewed and accepted prior to execution and
recording. Updated final plat shall be provided digitally for review prior to a
mylar being prepared. The following edits are requested, and any language
provided may be modified as warrantied.
a. Correct the title of the plat.
b. Correct bearing/distance closure error on survey.
c. Add plat note on install ditch crossings at time of driveway
construction with engineer plans approved by Farmer's lrrigation
Ditch Company.
d. Grading permits required for driveway construction.
e. Add a plat note to require a geo-tech analysis at the time of building
permit.
f. Add building envelope on Tracts 6 and 8 due to topography, possible
slope hazards and Tract 1 1B to avoid impacts of wetlands.
g. Add a plat note on future well permitting that each lot will be
subjected to Division of Water Resources policies and permitting
requirements associated with pre-existing platted lots.
h. Create a 4-way stop at the entrance to the main road into the
property at County Road 260 subject to approval by Road and
Bridge.i. Add a plat note recommending the Applicant to consult the Colorado
State Forest Service Firewise Construction guidelines or similar
future guidelines for new construction and landscaping on the
amended Tracts.
The Land Use and Development Code requires notification to the Board of County
Commissioners for their review and potential call-up of the Director's Decision.
The Board review is for a period of 10 calendar days commencing on the date of
the Director's Decision. The Amended Final Plat will be scheduled on the Board
of County Commissioner's consent agenda after expiration of the call-up period
and once all conditions of approval have been satisfied including editing of the plat
and acquisition of all necessary signatures. Please note that you will have 90 days

from the date of approval to submit a plat suitable for recording. Extensions of this
time period may be requested prior to the expiration of the original time limit.
