requirements. John Plano and his team deal with grading permits, so he will be your primary contact on this. Due

Dear Kelly,
The Elk Springs Homeowners Association has determined that the applicant's proposed low -density development
meets the criteria and standards under an existing agreement for use of the HOA's private road to access and
utility connections to its property for such proposed development.
An easement agreement has been drafted and there are just a couple of details on the cost share items the parties
are still negotiating, but essentially the right to use the road for access subject to compensation for road
maintenance is not in dispute.

I noticed that you are cc'd on Mr. Lee's email demanding a grading permit for the Elk Mesa project. I
understand that you represent the HOA that will ultimately issue the easement in question. Do you agree
with Mr. Lee's analysis? I would like to know if your client has any issues with Mr. Lee's claim of legal
access over the HOA property. I am open to setting up a time to discuss this on the telephone as well.

Hi John and Philip: I've outlined below my take on comments. Philip, please review add/edit as you see
fit and provide to John to allow the permit to move forward. Kelly was also going to reach out Chad on the
easement documentation issue. Thank to you both for dealing with this complicated
plan/application. Glenn.
Comments:
The Applicant needs to provide additional documentation of granting of easement from the Elk
Springs Development and HOA for the proposed roadway connection. Hard copies and reception
numbers for recorded documents need to be provided.
• Mapping and creation of the access easements withing the proposed Elk Mesa need to be
provided no later than at the time of building permit applications.
• The Applicant needs to provide additional documentation confirming consistency of the proposed
road cross section with existing Elk Springs roadways being utilized for access.
• The Applicant needs to document that the proposed additional traffic is consistent with Elk
Springs Development approvals. This needs to include confirmation that the required
intersection improvements at County Road 114 are still in place.
• Review and/or referral comments from County Road and Bridge need to be obtained.
• Compliance with Fire Protection District requirements needs to be demonstrated.
