Garfield County Community Development Department February 9, 2017 Mark Chain 811 Garfield Avenue Carbondale, CO 81623 RE: IRMW Minor Subdivision (MISA-09-16-8490) Director's Decision Dear Mark: This letter is provided to you as the authorized representative for the IRMW LLC application for a Minor Subdivision on the property located at 1058 County Road 100, approximately %z mile east of the Town of Carbondale. The Manager of the IRMW LLC is Bill Rice. The Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is hereby issued approving the Application for Minor Subdivision with the following findings: 1. That proper public notice was provided as required for the Director's Decision. 2. The Director's Decision review was extensive and complete, that all pertinent facts, matters and issues were submitted and all interested parties were given the opportunity to provide input prior to the decision date. 3. That for the above stated and other reasons the proposed Minor Subdivision is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoption of conditions the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended, including Section 5-301 (C) Minor Subdivision Review Criteria. The Application is approved subject to the following conditions: That all representations contained in the Application submittals shall be considered conditions of approval unless otherwise amended or changed by the Director's Decision. 2. Prior to the Board of County Commissioner's (Board) signing the plat, final review and approval by the County Attorney's Office and the County Surveyor shall be required. 3. Prior to the Board signing the plat, the following edits and modifications shall be required and subject to final review and approval by the County Attorney's Office and Community Development Staff. a. The plat shall be updated to include all existing easements including any for ditches, pipelines and the Mineral Spring. A reference to the Applicant's title policy shall be included in the survey notes on the plat. b. The plat shall be updated with easements for the water line and power lines being installed to serve Lot 1B. Where easements are located off - site the plat shall include a note identifying the easement and the reception number under which the easement was recorded. The width of the utility easements shall be acceptable to the utility provider. c. Certificates and signature blocks shall be updated in accordance with the County's standard certificates as noted in the County Resource Guide. This shall include a Lien Holders Certificate if determined necessary by the County Attorney's Office and the Applicant's title work. d. Building envelopes for both lots shall be included on the plat with those areas outside of the envelope clearly labelled as non -buildable to remain undisturbed. Building envelopes shall be limited to the level portion of Lot 1 B and the area of existing development on Lot 1A as shown in the Application submittals. e. References to setbacks on Lot 1 B shall be removed from the plat. f. Standard plat notes A, B, C, D, E, F, H, and I from the Resource Guide shall be added to the plat. g. The following plat notes shall be added to the plat. Final wording for the plat notes shall be subject to approval by the County Attorney's Office. o A site specific geotechnical, soils, and foundation analysis shall be required for all new construction. The analysis shall address soils, 2 geologic conditions, geologic hazards, and groundwater concerns. Compliance with the recommendations of the analysis shall be required. Engineered foundations may be required pursuant to the findings and recommendation of the geotechnical and soils analysis. Appropriate mitigation for geotechnical issues including but not limited to debris flow potential and rockfall shall be designed at the time of building permit in accordance with the geotechnical and soils analysis. o Addresses are to be posted where the driveway intersects the County road. If a shared driveway is used, the address for each home should be posted to clearly identify each address. Letters are to be a minimum of 4 inches in height, % inch in width and to contrast with background color. o Combustible materials should be thinned from around structures so as to provide a defensible space in the event of a wildland fire. o Future development on Lots 1A and 18 shall require compliance with Town of Carbondale Watershed Protection Requirements and Permitting as required. o In the case that future residential uses are proposed for the property, the calculation and payment of school land dedication fees shall be required at the time of land use change permitting. 4. The Applicant shall provide a landscape screening plan for the frontage along the RFTA Rio Grande Trail, implement said plan by June 30, 2017 and maintain said plan. Said plan shall include preservation of existing vegetation and removal of any noxious material or debris. 5. Prior to the Board signing the plat, the Applicant shall address the following conditions related to demonstration of a legal, physical, adequate, and reliable water source to serve both lots. a. The Applicant shall provide documentation acceptable to the County Attorney's Office that addresses the referral comments from the Division of Water Resources establishing a legal supply of water for the proposed subdivision. This shall include evidence of recorded copies of the water exchange agreement for Lot 1 B, contracts with the Basalt Water Conservation District for augmentation water for both Lots 1A and 1 B and updated well permits issued by the Division of Water Resources. Contracts with the Basalt Water Conservation District shall be maintained by the Applicant and future lot owners. b. The Applicant shall complete water quality testing for both lots that meet the testing requirements contained in the Land Use and Development Code, Section 4-230(M) confirming that the Colorado Primary Drinking 3 Water Standards are met, or the Applicant has otherwise identified a treatment system that will bring the water quality into compliance with the standards. A statement confirming compliance by a qualified professional or laboratory shall be required. c. The Applicant shall design and construct the water pipeline to serve Lot 1 B and provide the county with documentation from a licensed professional engineer of the proper installation and completion. 6. Prior to the Board signing the plat, safety signage for the Rio -Grande Trail crossing shall be installed on the Lot 1 B access driveway if determined necessary and required by RFTA. 7. Prior to the Board signing the plat, the Applicant shall provide a shared use and maintenance agreement for the access driveway serving Lot 1A. Said agreement shall be subject to review and approval by the County Attorney's Office and shall address future access improvements for the adjacent IRMW II property. 8. Prior to the Board signing the plat, the Applicant shall obtain comments from any Ditch Companies with ditches crossing the site indicating that the development proposal will have no impact on their ability to maintain the ditches and that an adequate maintenance easement is possible. 9. Prior to the Board signing the plat, the Applicant shall extend underground electric service to Lot 1 B. The installation shall be constructed by the utility provider (Holy Cross Electric), or constructed by the Applicant and inspected and accepted by the utility provider. Evidence of completion shall be provided to the County. 10. Prior to the Board signing the plat, the Applicant shall provide an inspection report on the existing OWTS serving Lot 1A, indicating that it is operating properly or if determined necessary detailing any required improvements. Said improvements if necessary shall be completed prior to execution of the plat. 11. Prior to the Board signing the plat, the Applicant shall complete and record any required documentation for the Boundary Line Adjustment with the adjacent Nieslanik property. A plat note referencing the Boundary Line Adjustment including recording information shall be included on the plat. 12. The Applicant shall provide a weed map and inventory of the site, a weed management plan, and evidence of weed treatments prior to June 30, 2017. The plan and treatment shall be subject to approval by the County Vegetation Manager. 13. Prior to June 30, 2017, the Applicant shall provide evidence of revegetation and stabilization of existing disturbed slopes on the site including those 4 associated with the existing grading permit and extension of utilities to Lot 1 B. The Applicant shall provide documentation to the County that the revegetation has been successful through two growing seasons. 14. The Applicant shall address wildlife compatibility by requiring use of bear proof trash containers or storing trash in a secured building or garage. 15. The Applicant shall consult the Colorado State Forest Service Firewise Construction guidelines for future improvements and landscaping on the site. 16. Any hazardous materials storage shall be in compliance with all State, Federal and OSHA requirements. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on February 16th. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once all conditions of approval have been satisfied including editing of the plat and acquisition of all necessary signatures and completion of all required improvements. Please note that you will have 90 days from the date of approval to submit a plat suitable for recording. Extensions of this time period may be requested prior to the expiration of the original time limit.
