The approximately 11-mile overall rebuild will follow the current route connecting the existing Hopkins Substation, located northeast of Carbondale, to the existing Basalt Substation, located west of Basalt. Approximately 3 miles of the transmission line is located in unincorporated Garfield County, consisting of 20 pole replacements total; the remainder of the Project will take place in Eagle County and within Bureau of Land Management (BLM) jurisdiction. This L&E review application only addresses the portion of the transmission line located within Garfield County jurisdiction. Xcel Energy is currently coordinating with Eagle County and BLM on permitting the portions of the Project located in those jurisdictions. Project representatives met with County Staff on December 2, 2021, for a Pre-Application Conference and again on December 14, 2023, and on July 2, 2025, where Xcel Energy provided information about the Project and responded to questions from County representatives about the Project. This L&E application has been prepared per the requirements outlined in the Pre-Application Conference summaries provided by Garfield County and complies with both the 2030 Garfield County Comprehensive Plan and the Garfield County Land Use and Development Code. Introduction Public Service Company of Colorado, a Colorado corporation conducting business as Xcel Energy (Xcel Energy), is proposing to rebuild the unincorporated Garfield County (County) portion of the existing 9256 Hopkins to Basalt 115 kilovolt (kV) transmission line (9256 Transmission Line) as part of Xcel Energy’s broader rebuild of the entire 9256 Transmission Line. This unincorporated Garfield County portion of the rebuild is referred to in this application as the “Project.” The existing transmission line must be rebuilt because it has reached the end of its operational life. The rebuilt transmission line will continue to operate at 115 kV and will be rebuilt to current design standards that include additional measures to reduce wildfire risk consistent with Xcel Energy’s 2020 Wildfire Mitigation Plan (Xcel Energy, 2020). This Project will mitigate wildfire risk by removing and replacing the existing aging infrastructure. The Project will rebuild an approximately 3-mile portion of the existing 9256 Transmission Line and replace 20 poles in the County. The approximate 11-mile overall rebuild of the 9256 Transmission Line will follow the current route connecting the existing Hopkins Substation, located northeast of Carbondale, to the existing Basalt Substation, located west of Basalt (Figure 1-1). This application applies only to the approximately 3-mile portion of the overall rebuild located in unincorporated Garfield County The rebuilt transmission line equipment within the Project area will be installed within the existing right-of-way easement (ROW Easement) boundaries, although temporary land needs for construction of the Project may extend outside of the ROW Easement. The transmission line right-of-way crosses the following jurisdictions: • Garfield County-3 miles (20 pole replacements) • Bureau of Land Management (BLM)-4 miles (25 pole replacements) • Eagle County-4 miles (31 pole replacements) This Location and Extent (L&E) Review application only applies to the portion of the Project located within unincorporated Garfield County. Xcel Energy is currently coordinating with Eagle County and BLM on permitting the portions of the Project located in those jurisdictions. This L&E Review application package was prepared per the requirements of Section 4-111, Table 4-201, and Section 4-203 of the Garfield County Land Use and Development Code (Code) as well as Xcel Energy’s Pre- Application Conference Summary. REGULATORY FRAMEWORK State statutes and land use regulations for the County apply to the 9256 Transmission Line rebuild, as applicable in each jurisdiction. Descriptions of the regulatory requirements for each jurisdiction are provided for convenience in the following sections and in Table 1-1. Any applicable land use, environmental, and construction permits will be obtained prior to the start of, or during construction, as necessary, pursuant to these regulatory requirements. i. State of Colorado Certain Colorado statutes apply to the Project, including those requiring notice to, and consultation with local permitting jurisdictions. ii. Garfield County Pursuant to the Code, this L&E Review application is being submitted for the 3-mile portion of the line within the County’s jurisdiction. A total of 20 proposed transmission line replacement poles are located within unincorporated Garfield County (pole locations 1-DE, 2-DE, 3-DE, 24, 25, 28, 29, 30-NTDE, 31, 32, 33, 34, 35, 36, 37, 38-NTDE, 39, 40, 41-DE, 42). iii. Eagle County An L&E application will be submitted for the 4-mile portion of the 9256 Transmission Line in Eagle County’s jurisdiction. There are 31 proposed poles within Eagle County jurisdiction (pole locations 43-NTDE, 44, 45, 46, 47, 48, 49, 50, 51-NTDE, 52-DE, 53, 55-NTDE, 56-NTDE, 59, 60-NTDE, 61-NTDE, 62, 63, 64, 65, 66, 67, 68, 69-DE, 70, 71, 72, 73-DE, 74, 75-NTDE, 76-DE). iv. Bureau of Land Management A ROW grant amendment application was submitted to the BLM in September 2021 for the 4-mile portion of the 9256 Transmission Line within BLM jurisdiction and a revised application was submitted in June 2024. The BLM is in the process of preparing an Environmental Assessment under the National Environmental Policy Act to evaluate this portion of the 9256 Transmission Line rebuild. A total of 25 transmission line replacement poles are proposed within BLM jurisdiction (pole locations 4, 5, 6, 7-NTDE, 8, 9-NTDE, 10, 11, 12, 13, 14, 15, 16, 17- NTDE, 18-NTDE, 19, 20, 21, 22-DE, 23, 26, 27-NTDE, 54-NTDE, 57, and 58). Eagle County L&E Review A public utility shall not be constructed or authorized until the location and extent has been approved by the county CRS 30-28- 110 Xcel Energy will submit the required application in Summer 2026. Bureau of Land Management ROW Grant Amendment An amendment to an existing grant is required when the use involves a substantial deviation from the grant 43 CFR 2807.20 Xcel Energy submitted the ROW Grant Amendment in September 2021, and BLM is currently preparing an Environmental Assessment to evaluate impacts under the National Environmental Policy Act. B. SUBMITTAL REQUIREMENTS Table 1-2 identifies the materials included in this application package to address the L&E Review requirements in Section 4-111, Table 4-201, and Section 4-203 of the Code. Application Components The following sections outline the components of this L&E Review application package. C. LAND USE APPLICATION FORM The completed Land Use Application form is provided in Attachment A. D. OWNERSHIP DOCUMENTATION The Project includes the replacement and rebuild of an existing electric transmission line between the existing Hopkins and Basalt Substations. The original electric transmission line was constructed within a utility easement ROW corridor held by Xcel Energy. Xcel Energy holds existing permanent land rights for the transmission line corridor. The Project will be constructed within the existing land rights, although Xcel Energy may amend and restate existing easements, as needed, to confirm or update existing easement rights for the rebuilt facilities. Xcel Energy will also obtain temporary land rights where needed for temporary construction activities. Names and addresses of property owners crossed by the Project centerline, the legal descriptions for each property, and the status of easements are provided in Attachment B. E. AUTHORIZATION FROM PROPERTY OWNERS Xcel Energy is submitting this L&E Review application for a public utility project under Section 4-111 of the Code and C.R.S. § 30-28-110. Attachment C addresses Xcel Energy’s authority to submit the application based on its existing land rights and the non-applicability of certain property owner authorization requirements. Accordingly, individual surface owner consent letters are not included with this application. F. AUTHORIZED SIGNATURES ON THE APPLICATION Authorized signatures from Xcel Energy representatives are provided on the completed Land Use Application in Attachment A. G. STATEMENT OF AUTHORITY A Statement of Authority is provided in Attachment D. H. APPLICATION FEE As indicated in the Pre-Application Conference Summary, provided in Attachment E, no application fee is required. Attachment F contains the completed Payment Agreement Form for County staff time and materials associated with application review. Xcel Energy will pay the review fees assessed by the County in accordance with the Code. I. PAYMENT AGREEMENT FORM Attachment F contains the completed Payment Agreement Form. J. PRE-APPLICATION CONFERENCE SUMMARY Xcel Energy Location and Extent Review Application 12 County staff provided a Pre-Application Conference Summary following the Pre-Application Conferences held on December 2, 2021, December 6, 2023, and July 22, 2025. All three Pre-Application Conference Summaries are included in Attachment E. At the Pre-Application Conference, County Staff determined that Location and Extent Review is the appropriate review process for the Project consistent with State statutes. K. VICINITY MAP A Vicinity Map is provided in Section 1 of this application. L. NAME AND ADDRESSES OF PROPERTY OWNERS WITHIN 200 FEET AND MINERAL ESTATE NOTICE ANALYSIS Names and addresses of surface property owners within unincorporated Garfield County within 200 feet of properties crossed by the Project centerline, as determined from the Garfield County Assessor’s records are provided in Attachment G along with a map showing the properties. A map showing proposed locations for posting public notice signs is also provided in Attachment G. Per the “Surface Development Notification Act” (C.R.S. § 24-65.5-101 et seq.) electric utility lines are exempt from the requirement to send notice of an initial public hearing to mineral estate owners. As this Project is a rebuild of an electric utility line, it is exempt from the statutory mineral estate mailing notification requirements. Please see Attachment C for more details. M. SITE PLAN A Site Plan is provided in Attachment H. Preliminary Plan and Profile drawings are provided in Attachment I. N. NARRATIVE DESCRIPTION Xcel Energy is proposing to rebuild the approximately 3-mile Garfield County portion of the existing 115-kV transmission line, known as the 9256 Transmission Line, between the existing Hopkins and Basalt Substations by replacing aging infrastructure while continuing delivery of economic, safe, and reliable electric service to customers in the County. The 9256 Transmission Line was originally constructed in 1909, with some poles being replaced in the 1990s. The 9256 Transmission Line has reached the end of its serviceable life and needs to be rebuilt. Due to ongoing growth and development in the County since the original transmission line was constructed, rebuilding the transmission line generally along the existing route is preferred to alleviate potential impacts of alternate alignments on the environment, community, and residents in Garfield County. The transmission line will be rebuilt to current industry standards that include additional measures to reduce wildfire risk per Xcel Energy’s 2020 Wildfire Mitigation Plan. The proposed 11-mile overall 9256 Transmission Line rebuild involves replacing all existing poles and cables (conductor and shield wires) between the existing Hopkins and Basalt Substations. The 9256 Transmission Line provides a source of power for communities in the County. The Project is needed to continue to provide power in these communities and maintain system reliability. The overall transmission line rebuild route begins at the Hopkins Substation, located in unincorporated Garfield County southwest of the intersection of Red Canyon Road and Fisher Cemetery Road, continues southeast, enters Eagle County approximately 0.4 miles east of County Road 102, and continues southeast through Eagle Xcel Energy Location and Extent Review Application 13 County to the Basalt Substation, located approximately 1 mile west of Basalt. This L&E Review application applies only to the portion of the rebuild in unincorporated Garfield County. The rebuilt transmission line will generally follow the existing route within the County as shown on the Site Plan in Attachment H and no re-routes are being proposed or considered. The current easement or ROW width is 100 feet and to provide safe and reliable access for construction, operation, and maintenance, the rebuilt transmission line will be constructed in the same 100-foot-wide easement ROW. The status of these easements is provided in Attachment B. Existing ROW will require vegetation management to create a safe working and operational space around the improved facilities. The following sections provide additional details about the Project. v. Pole Construction The rebuilt transmission line will follow the same route as the existing transmission line and will continue to operate at 115 kV. The rebuilt transmission line will be primarily constructed with steel H-frame transmission poles and strung with new conductor. Optical ground wire will be added to improve communication between substations and assist in preventing lightning strikes. In a limited number of locations in the County, steel 3- pole and monopole dead end structures will be used. Pole details are provided in Attachment J. Table 2-1 provides a description of the existing and proposed poles. Topography, span length, and adjacent land uses influence the necessary height of transmission poles. A table displaying changes to the pole heights is provided in Attachment K. Construction Methods Construction of the Project will occur in phases including the following activities: construction access development and vegetation clearing; equipment mobilization and material delivery; hole auguring and foundation construction; pole placement; conductor stringing; removal of existing poles and conductor, and revegetation of temporary disturbance areas. Access road improvements, grading, set-up of Temporary Construction Easement areas (TCE), and vegetation removal will be required prior to construction. Proposed access routes will allow construction crews and vehicles to access transmission line pole locations and TCEs. TCEs will be used to stage construction equipment and materials including construction trailers, cranes, and steel poles. TCEs are also necessary for pulling/tensioning sites that are used to string wire through new poles. The Site Plan (Attachment H) identifies the proposed pulling/tensioning areas needed to support the Project, including locations subject to Garfield County land use jurisdiction and locations on BLM-managed lands that will be addressed through the BLM authorization process, as applicable. One staging area is proposed within the County and will be permitted separately from this L&E application through a Temporary Use Permit application. Material deliveries from the nearest staging area to the ROW Easement will be made either by truck along the temporary access routes or by helicopter. Vegetation management within the existing ROW Easement will be required prior to, or in conjunction with, construction. Trees and vegetation growing within and near the ROW Easement pose a potential risk to the transmission line by causing downed lines, power outages, and wildfires. Vegetation management crews prevent the risk of these occurrences by implementing various types of treatment including removing, pruning, and mowing vegetation, and application of approved herbicides to treat vegetation to allow safe operation of the transmission line. Depending on current levels of vegetation encroachment and ROW Easement needs, the extent of vegetation management will vary along the rebuilt ROW Easement. Following civil work, holes will be augured for transmission poles. Once holes are augured, the poles are set and backfilled. Some poles may require foundations that are cast-in-place concrete drilled-shaft foundations in the augured holes with a steel reinforcement cage. Transmission poles will be placed in the holes or on the foundation using a crane or helicopter. Poles are transported via truck to the installation locations where a Xcel Energy Location and Extent Review Application 15 crane will lift the poles into place. Helicopter installation involves assembling the poles in a material staging area, then transporting them via helicopter to the installation locations to be lowered into the hole or onto a foundation. Additionally, some existing poles will be removed by helicopter depending on terrain and access. The existing poles will be either flown or driven to a staging area for off-site disposal. There are advantages to using a helicopter for installation because it permits access to areas that are not feasible for vehicle ground access, minimizes construction impacts due to erosion and disturbance, and improves construction efficiency. Within the Project Area, pole installation and removal will be supported by using a helicopter. Any areas requiring helicopter construction methods will follow Federal Aviation Administration (FAA) safety requirements. Xcel Energy and their construction contractor will coordinate with the FAA and the County during helicopter operations and obtain any additional necessary permits. Xcel Energy and the construction contractor will provide residents with prior notice should temporary evacuation be required during helicopter operations. Following setting of the transmission poles, conductor wire is strung using a temporary pulley system which is attached to the insulators. Pulling/tensioning sites are required at specific angles, so the conductor wire is pulled in line with the poles, remaining in alignment. Once the conductor is in place, the existing poles and conductor will be removed by crane or by helicopter depending on terrain and access, and the Project will be energized. Throughout construction, wind erosion control best management practices (BMPs), including the application of water or other dust palliatives, will be implemented as required. Following construction, the temporary pulling/tensioning sites and other temporary disturbance areas will be restored to a condition reasonably similar to the pre-construction condition. Xcel Energy’s Revegetation Plan and Weed Management Plan are included in Attachment L. vii. Height of Poles and any Increase in Height from Existing Poles A comparison chart for the differences between pole heights is included in Attachment K. viii. Visual Mitigation The presence of the existing transmission line has previously created a visual impact. The Project will rebuild the existing line to update its materials and bring it into compliance with current industry design standards. Accordingly, it is not anticipated that the Project will negatively impact the character of the surrounding area or create new significant visual disturbances for the following reasons: (1) the new transmission line route will be rebuilt within the existing ROW Easement; (2) the total number of transmission poles will be reduced from 21 to 20; and (3) the updated weathering steel materials for the new transmission poles and their corresponding current design standards will minimize any existing visual impacts. While some new poles will be taller than the existing poles, their overall appearance will not materially change or substantially impact the area because weathered steel is designed to blend in with the surrounding landscape. Temporary visual disturbance may occur during construction of the Project due to the temporary access roads, presence of construction vehicles and active work areas, and the use of cranes and helicopters for pole installation. Vegetation removal is not anticipated to be of an extent to create a visual impact to the region as a whole. After construction, the work areas and ROW Easement will be restored to the condition existing prior to construction or as required in easements with landowners. ix. Visual Modeling and Photo Simulation Visual simulations are included in Attachment M. Xcel Energy Location and Extent Review Application 16 x. Access Information Proposed construction access routes will allow construction crews and vehicles to safely access transmission line pole locations, pulling/tensioning sites, and material staging areas. Access to the existing and new pole locations will be required during construction in the form of temporary access routes to remove old poles and install new ones. Some temporary access will be required only for crews to walk in and access the pole locations with hand equipment and tools. Existing public and private roads will be utilized during construction, operation, and maintenance of the Project. Access permissions through private property are being obtained from landowners by Xcel Energy. Included in the proposed construction access routes for the Project are U.S. Highway 82, Harmony Lane, Missouri Heights, Catherine Store Road, Cattle Creek Road, and Red Canyon Road, as well as additional access roads shown on the Site Plan in Attachment H. Where road improvements are needed, Xcel Energy will secure the necessary permits to comply with County regulations, including grading, stormwater, and erosion control permits. A Drainage Memo is included in Attachment N. A detailed Grading Plan outlining the locations of proposed temporary access and the improvements needed will be provided prior to construction, as required. If new access is required, Xcel will secure the necessary permits from Garfield County, the appropriate municipality, Colorado Department of Transportation (CDOT), or other agency with jurisdiction, as required. xi. Temporary Construction Easements Xcel Energy plans to utilize temporary staging areas for the delivery, storage, and distribution of materials to support the Project. One staging area to support the Project will be located in the County and will be permitted separately from this L&E application through the County’s temporary use permit process. The staging area will be used for approximately 6 months. Xcel Energy will coordinate the beginning of use of this staging area for purposes of the 6-month Temporary Use Permit limitation but anticipates use to begin in Spring 2027. Materials for the rebuild will be delivered to the staging area during construction. These materials will be transported to the ROW either by flat-bed truck or helicopter. Materials that may be staged at this area include poles and reels of conductor and shield wire. Equipment that may be stored at the staging area includes backhoes, bucket trucks, and crane trucks. During construction, personnel pick-up trucks may be parked at the staging area during the day. The staging area will be in use during the typical construction workweek; up to 7 days per week and up to 12 hours per day. Additional time may be needed for maintenance in the construction staging area. Xcel Energy will obtain and comply with any permits required for operation of the staging area. The staging area will be fenced for security and screening. Vegetation clearing and grading may be required to level the area for material and equipment placement. BMPs will be implemented to reduce stormwater-related impacts to nearby waterbodies. Wind erosion control BMPs including the application of water or other dust palliatives will be implemented, if needed. Upon completion of construction, Xcel Energy will remove any leftover material and restore the staging area, if needed. Xcel Energy’s Revegetation Plan is included in Attachment L. Temporary easements and other temporary construction rights or authorizations will be necessary for placement of pulling and tensioning machines for stringing conductor wire. Vegetation clearing and grading may be required at some pulling/tensioning sites to level out the area for equipment placement. Any permits required for grading these sites will be obtained for this work. BMPs will be implemented to reduce stormwater- related impacts to nearby waterbodies. Wind erosion control BMPs, including the application of water or other dust palliatives, will be implemented, if needed. Upon completion of construction, all equipment will be Xcel Energy Location and Extent Review Application 17 removed from the sites and the sites will be restored generally consistent with preconstruction conditions in accordance with Xcel Energy’s Revegetation Plan (Attachment L). xii. Traffic Information During construction, individual lane or complete road closures may be required to allow crews and vehicles to safely access the transmission line pole locations. When road closures are required, Xcel Energy will secure the necessary permits to comply with County regulations and will supply necessary traffic control plans to the County. A helicopter will fly over local roads in the County including Fisher Cemetery Road, Cattle Creek Road, Catherine Store Road, and other potential private roads depending on the helicopter flight path for construction of the Project. Road closures will be intermittent, temporary, and will occur when a helicopter crosses over the road while carrying material loads. Closure signage will be installed ahead of construction to notify road users. During construction, flaggers will control traffic based on ground-air communications and minimize closures to periods only necessary to safely cross the roadways. Typical closures are less than five minutes per flight over the roadway. Final flight paths and traffic control plans will be based on the final selection and contracting of the helicopter vendor. A final flight plan and traffic control plan will be provided to the County prior to construction. xiii. Construction Duration and Timing Construction is scheduled for 2027, pending permit approvals. Construction and restoration activities are expected to be completed by Fall 2027, and the Project will be put into service by Winter 2027. See Table 2-2 below for the anticipated Project schedule. Statement Addressing Review Criteria in Section 4-111.C Section 4-111.C of the Code establishes Review Criteria for applications for a Location and Extent Review as follows: The Planning Commission shall determine whether the project is in general conformance with the Comprehensive Plan. Section 3 and Section 4 of this application describe how the Project generally conforms with the Garfield County Comprehensive Plan 2030, as amended February 26, 2020. O. CONFORMANCE WITH GARFIELD COUNTY COMPREHENSIVE PLAN The vision of the Garfield County Comprehensive Plan is to manage growth to promote thriving communities and a diverse economy while protecting wildlife and maintaining the natural environment to protect Garfield County’s western heritage. (Garfield County 2020a, Chapter 2, Vision for Garfield County). Aside from the transmission pole foundation footprint, land uses in areas under and around the transmission line will remain unchanged. Thus, the location of the Project will preserve the quality of the natural environment and preserve the County’s rural and western heritage. Additionally, the Project will remove and replace aging infrastructure with current materials and rebuild the electric transmission line to current industry standards that include an additional measure to mitigate wildfire risk (i.e., steel poles replacing wood), which will reduce risk to the natural environment. Optical Ground Wire (OPGW) will be added to improve communication between substations and assist in preventing lightning strikes. Rebuilding the existing transmission line to current industry standards will provide for continued delivery of safe and reliable electric service to customers in Garfield County and western Colorado. A detailed narrative describing how the Project conforms to the Garfield County Comprehensive Plan 2030 sections, goals, and objectives is provided below in Section 4 of this application. Xcel Energy Location and Extent Review Application 19 4. References to the Comprehensive Plan Garfield County Comprehensive Plan 2030 outlines key policies and strategies that support the County’s vision for 2030 (Garfield County 2020a). The Vision for Garfield County is dedicated to managing and directing growth to dedicated Urban Growth Areas (UGAs) and other areas that can accommodate growth cost effectively, in order to create thriving communities while promoting a diverse, sustainable and healthy economy, protecting wildlife, maintain or improving the quality of our natural environment, and preserving the County’s rural and western heritage (Garfield County 2020a). The following sections outline how the Project supports specific components of the Garfield County Comprehensive Plan 2030. P. CHAPTER 2 FUTURE LAND USE Chapter 2 of the Comprehensive Plan outlines five major themes to support future land use in Garfield County. One theme focuses on development in UGAs and 3-Mile Areas of Influence, which are preferred locations for municipality expansion. According to the Garfield County Future Land Use Map, there are no UGAs near the Project or 3-Mile Areas of Influence (Garfield County 2020b). The Project falls within the following future land use designations: • Residential Low which may include agricultural uses, ranching, low density residential uses, and home occupation uses that can be adequately buffered from adjacent incompatible uses. • Residential Medium which may include small farms, estates, residences, and clustered residential subdivisions. The character of the Project matches that of similar development that may occur within these future land use designations. Further, the Project supports the development of these future land use designations by upgrading the existing electric infrastructure to ensure safe and reliable service. Q. CHAPTER 3, SECTION 4 – ECONOMICS, EMPLOYMENT, AND TOURISM The vision of Chapter 3, Section 4 of the Garfield County Comprehensive Plan 2030, emphasizes economic development in and around County population centers. The Colorado State Demography Office (CSDO) projects that from 2017 to 2040 the county's population will increase by an average of 1,287 persons per year. This is a 55 percent increase from the annual average between 2001 and 2017. The CSDO projections highlight important planning considerations concerning where and how to accommodate future growth, and how to ensure that public infrastructure and services will accommodate this growth (Garfield County 2020a). By replacing the existing aging infrastructure and ensuring continued reliable energy service to Garfield County, the Project supports the growth of industrial, commercial, and residential uses in the surrounding areas. xv. Policy 2 – Enhancing the Tourism Industry The tourism industry is an important part of the regional economy and is enhanced by open space, scenic vistas, public trails, and recreational opportunities. Rebuilding the transmission line in the existing ROW Easement will not create any new negative impacts to open space, scenic vistas, public trails, and other recreational opportunities but will preserve these elements within Garfield County. xvi. Policy 3 – Visual, Traffic, and Environmental Impacts Xcel Energy Location and Extent Review Application 20 Visual, traffic, and environmental impacts of new or expanded industrial development upon tourism, quality of life resources, and community character will be considered. The Policy 3 strategy is to ensure that impacts from industrial development are adequately mitigated to minimize negative impacts on tourism, quality of life resources, and community character. 1) Visual Section 2.N.viii. of this application details the anticipated visual impacts of the Project and associated mitigation measures. Because the Project involves replacing an existing transmission line along the same easement corridor with fewer poles on the landscape than the existing transmission line, it is not anticipated that the Project will result in any new negative visual impacts to the surrounding community. Furthermore, the transmission poles will be weathered steel material to blend with the surrounding landscape. Visual simulations are provided in Attachment M. 2) Traffic The Project will not generate trips in excess of those already needed for the existing transmission line for maintenance or emergencies. Planned maintenance will occur along the line less frequently than it does for the existing line due to the new transmission line materials requiring less maintenance. No operational impacts to daily traffic flows are anticipated by the completed Project. During construction, there will be temporary disruptions to traffic due to the need for equipment and material deliveries to access the line. As discussed in Section 2.N.x. of this application, if roadway traffic controls are determined to be necessary, Xcel Energy will submit Traffic Control Plans as applicable to the County. 3) Environmental Impacts The approximate 3-mile transmission line area within unincorporated Garfield County includes rural and public lands zones. The line will be rebuilt to current industry design standards that include additional measures to reduce wildfire risk while using the existing transmission line corridor and access routes, where possible. It is favorable to replace and improve the Project along the existing transmission line corridor rather than create entirely new impacts in new locations. The Project avoids creating new impacts to the area because it will upgrade the current transmission line along the existing easement. The Project mitigates impacts to landowners by upgrading the existing transmission line so that it is less vulnerable to causing or being damaged by a wildfire, thereby increasing the overall reliability of the electric system. Wildfires pose a significant threat to communities, and this Project will proactively minimize ignition risks. Xcel Energy will obtain any required environmental permits and approvals prior to construction, and any required environmental mitigation measures will be implemented. As discussed in Section 1.A.iv. of this application, Xcel Energy has applied for a BLM ROW grant amendment, and an Environmental Assessment is being prepared for that segment of the Project. xvii. Policy 4 – Economic Resiliency and Diversity Policy 4 aims to strengthen the County's economic resiliency for employment and income generation by continuing to diversify the economy (Garfield County 2020a). Several strategies associated with this policy focus on encouraging growth and expansion of existing industries within Garfield County. The Project will not only revitalize and strengthen the electric infrastructure within Garfield County, but the line’s 115 kV capacity can operate to meet the future demand of development within Garfield County well into the future. xviii. Policy 5 – Locations that Possess Physical Features and Community Facilities and Services Xcel Energy Location and Extent Review Application 21 Policy 5 encourages commercial and industrial development in areas with appropriate community facilities and services (Garfield County 2020a). The Project will continue to provide electric service to the same area as the existing line, the line will also be rebuilt to ensure reliable service through modern design to communities it serves. R. CHAPTER 3, SECTION 5 – RECREATION, OPEN SPACE, AND TRAILS The vision of Chapter 3, Section 5 of the Garfield County Comprehensive Plan 2030 is to ensure open spaces, recreational trails and parks are available throughout the county. Policy 2 supports the protection of public access to rivers, streams and public lands along with the preservation of valuable outdoor recreation and open space lands. The Powerline Trails Act was passed by the Colorado legislature in 2022 to help raise awareness and create opportunities for Public Entities, defined as “the state, a local government, or a district” to co-locate public recreation trails within Transmission Corridors. The General Assembly sought to encourage, facilitate, and accelerate Powerline Trail development within Colorado while recognizing that the co-location of such trails needs to occur with safety in mind. When Xcel Energy seeks to site a new transmission line or rebuild an existing transmission line within a local jurisdiction, Xcel Energy’s role with respect to Powerline Trails under the Act is to (1) notify local governments of the potential for construction of a Powerline Trail within the Transmission Corridor, and (2) help inform the Public Entities of the guidelines for which a trail can safely co-locate within the Transmission Corridor. Xcel Energy has a long history of working with local governments who wish to co-locate public recreation trails within its Transmission Corridors and will be happy to address any thoughts, questions, or interest Garfield County may have in potential future Powerline Trails related to the Project. S. CHAPTER 3, SECTION 8 – NATURAL RESOURCES The vision of Chapter 3, Section 8 of the Garfield County Comprehensive Plan 2030 emphasizes the need to protect and/or mitigate impacts to biological resources. The Project will be constructed along the existing alignment within the County, reducing new impacts to surrounding land use and resources. Xcel Energy will implement any required mitigation measures to protect natural resources, as required by the BLM ROW grant or other environmental clearances for the Project. xix. Policy 2 – Avoid Disturbance and Mitigation Impacts Policy 2 discusses the need to avoid disturbance to wildlife habitat and mitigate potential negative impacts that cannot be avoided. Project construction may impact nesting raptors if construction takes place during their breeding seasons. If Xcel Energy constructs during breeding season, raptor nest surveys will be conducted prior to construction to determine whether active nests are present near the Project. Additionally, seasonal restrictions on construction activities will reduce disturbance to birthing big game animals and animals with dependent young. Additional wildlife restrictions will be incorporated into construction planning based on BLM and Colorado Parks and Wildlife (CPW) guidance. Xcel Energy has been coordinating with CPW and discussions with the organization are ongoing. Potential impacts to wildlife habitat will be temporary and limited to the construction phase. In areas where grading is necessary, Xcel Energy will revegetate the area after construction is complete to a condition similar to its pre-construction condition; the Project's Revegetation Plan is included as Attachment L. Because the Project Xcel Energy Location and Extent Review Application 22 involves rebuilding an existing transmission line entirely in place, it is not anticipated that the Project will result in new, permanent, adverse impacts to wildlife. xx. Policy 3 – Agency Coordination Xcel Energy is coordinating with CPW regarding strategies to avoid, minimize, and mitigate adverse effects to wildlife habitats. Dear Ms. Cave: I am writing to you on behalf of Public Service Company of Colorado, a Colorado corporation conducting business as Xcel Energy (“Xcel Energy”) regarding the above-captioned Project and related Location & Extent Review (“L&E”) application. Consistent with your prior discussions with my colleague Mr. Gil McNeish, in relation to other recent transmission line rebuild projects within Garfield County and the accepted applications for those projects, this letter summarizes the general characteristics of the current Project and Xcel Energy’s authority to file the L&E application, as well as the rationale for non-applicability of certain general submittal requirements found in Garfield County’s Land Use and Development Code (“LUDC”), specifically, Article 4, Division 2., Section 4- 203 B., Sub-section 1.a – c. and Sub-section 3. b. The L&E application seeks approval from the Garfield County Planning Commission for the rebuild of the approximately 3-mile unincorporated Garfield County portion of the existing 11-mile 115 kV Hopkins to Basalt transmission line, known as the 9256 Transmission Line. The existing 9256 Transmission Line was constructed in 1909 and is being rebuilt to replace aging infrastructure and continue delivery of reliable electric service to customers in Garfield County and the surrounding areas. Additionally, the Project is part of Xcel Energy’s Wildfire Mitigation Program, which is a critical component of Xcel Energy’s ability to continue safely delivering service to its Garfield County customers. The Project will be constructed within the existing transmission line’s corridor. On private lands crossed by the Project, Xcel Energy holds existing easement rights, certain of which may be renewed, amended, or restated to confirm and modernize existing rights for the rebuild. Portions of the overall 9256 Transmission Line rebuild on BLM-managed lands will be addressed through the BLM Ms. Kelly Cave, Assistant County Attorney Garfield County Attorney’s Office June 16, 2026 Page 2 right of way authorization process. Xcel Energy will obtain any temporary construction, access, staging, pulling/tensioning, and helicopter-related rights needed for the Project before construction. Xcel Energy is providing this letter summarizing its authority to file the L&E application and the non-applicability of certain general LUDC submittal requirements to the L&E application. Consistent with prior applications, Xcel Energy will not be requesting a waiver of these submittal requirements, and it is my understanding the L&E application will not be deemed incomplete by the County for failing to include information required by the general submittal requirements discussed in this letter. With respect to the submittal requirements in LUDC Sub-sections 4-203.B.1.a. – c. and Sub- section 4-203.B.3.b., Xcel Energy’s approach and reasoning are as follows: 1. Sub-Section 4-203.B.1.a. - c. Letter signed by all landowners affected by the Project consenting to submission of the application. Response – LUDC Sub-section 4-203.B.1.a requires that if “the Applicant is not the owner of the land, or is a contract purchaser of the land, the Applicant shall submit a letter signed by the owner consenting to the submission of the application.” Because Xcel Energy is the beneficiary of easements within a Right-of-Way (“ROW”) corridor for the existing transmission line, it already holds a recognized property interest in the land for which the Project is proposed. Accordingly, Xcel Energy does not require the consent of the fee owners to submit the L&E application for any Project development that occurs within Xcel Energy’s existing easements. As mentioned above, the Project will be rebuilt in the current alignment of the existing transmission line. Xcel Energy has provided a list of landowners affected by the Project in Attachment B of the L&E application, which also includes the status of necessary amended or restated easement acquisitions. Xcel Energy strives to acquire all necessary easements through negotiations with landowners. If those negotiations are unsuccessful, however, Xcel Energy does have the right to exercise the power of eminent domain to acquire the property interests necessary for the Project. Because of that right, and the unique circumstances associated with public utility projects of statewide concern such as this Project, Xcel Energy has the authority to file the L&E application without the fee landowner’s consent. Accordingly, Xcel Energy’s L&E application will not include letters of consent from those landowners who have fee title interest in the land for which the Project is proposed. Xcel Energy is, of course, willing to accept as a condition of approval a requirement that prior to starting any Project construction activities on a parcel, Xcel Energy will provide the County with evidence that it has obtained all requisite easements for development of the Project on that parcel. 2. Sub-Section 4-203.B.3.b. A list of mineral estate owners affected by the Project. Ms. Kelly Cave, Assistant County Attorney Garfield County Attorney’s Office June 16, 2026 Page 3 Response – LUDC Sub-section 4-203.B.3 states as follows: “If an application requires mailed notice, the application shall include …. b. A list of mineral estate owners in the Subject Site, their name, and the mailing address for each owner or lessee.” According to Table 4-102, Common Review Procedures and Required Notice, mailed notice is required for Location and Extent Review applications. Under LUDC Sub-section 4-101.E.1.b.(4), an applicant shall provide written notice to owners of mineral interests in the subject site in accordance with C.R.S. § 24-65.5-101, et seq. (“Surface Development Notification Act”). The Surface Development Notification Act provides that not less than thirty (30) days before the date scheduled for the initial public hearing by a local government on an application for development, the applicant must send a notice of that hearing by certified mail to mineral estate owners—defined as owners or lessees of the mineral estate under the property which is the subject of the application. The definition of an “Application for Development” under the Surface Development Notification Act covers a wide range of surface development land use approvals, but certain development activities are expressly exempt from that definition. One exemption includes applications with respect to utility electric lines such as Xcel Energy’s transmission line for the Project. Thus, due to the nature and scope of the Project, the Project is exempt from the statutory notice requirements of the Surface Development Notification Act. Accordingly, Xcel Energy’s L&E application will not include a list of mineral estate owners and lessees. Outlined below are brief descriptions of the three projects: Mitchel to Rifle-Ute: Originally Built in the 1940’s - 1960’s, approximately 25 miles, steel H frame structures, helicopter use is likely. Rifle-Ute to DeBeque: Originally constructed in the 1960’s, approximately 32 miles, use of a variety of structures including single pole weathered steel or brown fiberglass self-supporting or guyed structures, helicopter use may be required. Hopkins to Basalt: Originally constructed in 1909 with upgrades in the 1990’s, 11 miles, H frame, monopole, and 3-pole dead end weathered steel or brown fiberglass self-supporting or guyed structures. Helicopter access is likely. STAGING AREAS – HELICOPTER USE The project is part of Xcel Energy’s Wildfire Mitigation Program. Most alignments will utilize existing right-of-way/easements. Some minor realignments may be implemented and would require acquisition of new right-of-way/easements. Creation of staging areas was discussed and subsequent to the meeting preliminary information on potential staging areas was provided. Most are located directly adjacent to the transmission line alignment on property already associated with the projects. Temporary Use Permits should be applied for the storage/laydown and helicopter pads. The preapplication conference for these was held concurrently with this update conference. RIGHT-OF-WAY, OWNERSHIP, PUBLIC NOTICE Documentation of right-of-way/easement and as appropriate other authorizations or agreements for the rebuild will be a key component of the application submittals and will include review by the County Attorney’s Office. The County Attorney’s Office will also be essential in reviewing compliance with the public notice requirements including mailing to adjacent property owners within 200 ft. and mineral rights owners on the subject properties. It is highly recommended that prior to formal application submittal the Applicant’s research, mailing lists and legal description for the project be reviewed with Staff and the County Attorney’s Office. Information related to the exemption of this application from any notice provisions should be provided as early as possible for review by the Attorney’s Office. All owners of property on which the transmission line will be rebuilt will also be noticed. The Public Notice publication and posting as well. Publication is in the Rifle Citizen Telegram (one time publication required). Posting should be placed in location where the alignment crosses a public right-of-way such as County Roads and in other locations where visible from a public right-of-way. Given the length of the projects, staff recommends that the Applicant 3 provide in the Application submittals a map showing proposed locations for posting notice signs, for review by Staff. GENERAL PROJECT DESCRIPTION Xcel Energy is proposing three line rebuild projects throughout the County. General alignment mapping of the transmission lines and project summaries were provided at the pre-application meeting and are attached. Outlined below are brief descriptions of the three projects: Mitchel to Rifle-Ute: Originally Built in the 1940's - 1960's, approximately 25 miles, steel H frame structures, helicopter use is likely. Rifle-Ute to DeBeque: Originally constructed in the 1960's, approximately 32 miles, use of a variety of structures including single pole weathered steel or brown fiberglass self- supporting or guyed structures, helicopter use may be required. Hopkinsto Basalt: Originallyconstructed in 1909with upgrades inthe 1990's, 11 miles, H frame, monopole, and 3-pole dead end weathered steel or brown fiberglass self-supporting or guyed structures. Helicopter access is likely. STAGING AREAS _ HELICOPTER USE The project is part of Xcel Energy's Wildfire Mitigation Program. Most alignments will utilize existing right-of-way/easements. Some minor realignments may be implemented and would require acquisition of new right-of-way/easements. Creation of staging areas was discussed and subsequent to the meeting preliminary information on potential staging areas was provided. Most are located directly adjacent to the transmission line alignment on property already associated with the projects. Where staging areas are separate for the transmission line alignment additional Land Use Change Permitting may be required. Helicopter use for staging areas needs to be addressed and likely will require additional meetings with Staff to determine if additional permitting is required. Helicopter use raises questions regarding noise and safety considerations. RIGHT-OF-WAY, OWNERSHIP, PUBLIC NOTICE Documentation of right-of-way/easement and as appropriate other authorizations or agreements for the rebuild will be a key component of the application submittals and will include review by the County Attorney's Office. The County Attorney's Office will also be essential in reviewing compliance with the public notice requirements including mailing to adjacent property owners within 200 ft. and mineral rights owners on the surbject properties. It is highly recommended that prior to formal application submittal the Applicant's research, mailing lists and legal description for the project be reviewed with Staff and the County Attorney's Office. Atl owners of property on which the transmission line will be rebuilt will also be noticed. The Public Notice publication and posting as well. Publication is in the Rifle Citizen Telegram (one time publication required). Posting should be placed in location where the alignment crosses a public right-of-way such as County Roads and in other locations where visible from a public right-of-way. Given the length of the projects, staff recommends that the Applicant provide in the Application submittals a map showing proposed locations for posting notice signs, for review by Staff. GENERAL NOTES County Staff has determined that the Location and Extent Review is the appropriate review process for the re-build project and is consistent with State Statutes. Please advise us of ) any changes in p¡ans or project descriptions as that may affect the determination and/or require updates to the pre-application summary and related information. Xcel Energy plans to meet with the Board of County Commissioners to provide them with updates and information on the rebuild projects with a meeting currently scheduled for April 4th. Public Service Company of Colorado (PSCo), a subsidiary of Xcel, is the owner and operator of 4,7!8 miles of transmission lines in Colorado. Transmission Line 6584, a 69-kilovolt (kV) that runs from the Shoshone Substation in Garfield County to the Cameo Substation in Mesa County. This transmission lines, originally constructed in the L940s through the L960s, is approaching the end of its serviceable life. The proposed Rebuild of Transmission Line 6584 (6534) involves replacing all existing structures and cables (conductor and shield wires) between the Mitchell Substation to the Ute-Rifle Substation, approximately 25 miles (Project). Currently, transmission Line 6584 has a permanent ROW width of 30-50 feet and provides a source of power for communities ín Garfield County. The Project ís needed to continue to provide safe and reliable power into those communities that are the major users along the route. This project will involve construction act¡v¡t¡es to replace 25 miles of the 69 kV single-circuit transmission line 6584, which transects BLM, state, and private lands. The alignment for 6584 would be located largely within the existing alignment. Minor exceptions may occur should any topographic or sensitive resources be identified; the new alignment could be moved east or west of the existing alignment within public lands to avoid or reduce resource impacts. The existing 30 to SO-foot-wide permanent ROW would be increased to a 75-foot RoW and the line would be upgraded from the existing 69 kV rating to a 1-15 kV rating (Project Area). The components of the Project include: a a Approximately 25 miles of transmission line 6584 will be rebuilt. The existing 30 to S0-foot ROW will be increased to a 75-foot ROW' The existing wood H-frame transmission line structures will be replaced with steel H-frame structures. The total number of structure locations is anticipated to be similar to the existing structure locations. Access to the ROW will be primarily from existing public ROWs, such as state or county roads. ln certain locations, access will be across public or private land with explicit permission from the landowner. Helicopter access is likely to be required during construction of the lines in steep a a a terrain, Helicopters will travel to the construction staging area to land and collect construction materlals, lncludlng structures. The hellcopter wlll set down or plck up materials, wlthout landing in the ROW, whíle crews disconnect the materials from the haul cable, freeing the helicopter to depart. The Project is anticipated to be divided into two main segments of construction. The segments (subjectio change based upon further study) are: o Segment 1: Mitchell Substation to Newcastle Substation - ground and helicopter construction, approximately 12 miles. o Segment 2: Newcastle Substation to Rifle Substation - ground construction and helicopter, approximately 13 miles. Public Servíce Company of Colorado (PSCo), a subsidiary of Xcel, is the owner and operator of 4,778 miles of transmission lines in Colorado. Xcel is proposing a rebuild of the Hopkins to Basalt L15 kilovolt (kV)Transmission Line 9256 (Transmission Line e2s6). Transmission Line 9256 was originally constructed in L909, with some structures being replaced in the 1990s. The line has reached the end of its serviceable life. The proposed L1-mile rebuild of Transmission Line 9256 (Project) involves replacing all existing structures and cables (conductor and shield wires) between the Hopkins and Basalt Substations. Transmission Line 9256 has 4 miles of 100-foot permanent right-of-way (ROW) width on Bureau of Land Management (BLM) land and provides a source of power for communities in Garfield and Eagle Counties (Project Area). The Project is needed to continue to transfer power in these communities that are the major users along the route and maintain system reliability. The project alignment would be located largely within the existing alignment. Minor exceptions may occur should any topographic or sensitive resources be identified; the new alignment could be moved east or west of the existing alignment within public lands to avoid or reduce resource impacts' Otherwise, the existing lOO-foot-wide permanent ROW would be used. Transmission Line 9256 would ma¡ntain its existing 1-15 kV rat¡ng. The components of the Project include: . Approximately 11 miles of Transmission Line 9256 will be rebuilt, of which 4 miles are on BLM land within Colorado River Valley Field Office (CRVFO)jurisdiction. The existing 100-foot ROW is expected to be adequate with minor exceptions should any topographic or sensitive resources be identified. . The existing wood H-frame transmission line structures and towers will be replaced with a family of structures that consist of H-frame, monopole, and 3-pole dead end weathered steel or brown fiberglass self-supporting or guyed structures. TRANSMISSION LINE 9256 REBUILD PROJECT ATTACHMENT L: Revegetation Plan and Weed Management Plan 1 Memo Date: Monday, April 06, 2026 Project: 9256 Hopkins Substation to Basalt Electric Transmission Line Rebuild To: Garfield County, Colorado From: Brian Brown - HDR Subject: Revegetation Plan Public Service Company of Colorado (PSCo), a Colorado corporation doing business as Xcel Energy, must replace the existing transmission line between the Hopkins to Basalt Substations. This line generally crosses rural undeveloped land. The new structures will be within the existing transmission easement and accessed via existing private or public roads and existing and new access routes. The intent of this Revegetation Plan is to restore surface native type ground cover. While there are multiple construction types for this project, i.e. temporary pad grading, permanent access grading, structure base excavation, etc., they are all fairly similar. Below is the general sequential approach to minimize disturbance and promote revegetation across the project. This will have to be slightly customized to each construction type and site conditions. 1. Prior to the start of construction, a surveyor will stake pole locations, off-sets, temporary construction areas, and other locations of importance where field delineation is beneficial. 2. Appropriate PSCo staff, line construction contractor, foundation contractor, earthwork contractor, and erosion control contractor will meet on-site to review the delineated construction impact limits. 3. Flagging or paint used to delineate where perimeter erosion control measures should be placed based on disturbance limits defined by PSCo construction team (item 2 above). 4. PSCo erosion control plan developer, PSCo Environmental Analysist, or erosion control install contractor may collect multiple representative topsoil soil samples for analysis along the transmission line. This analysis would focus on the potential for possible soil amendments (primarily nitrogen, phosphorus, and potassium) during seeding. 3 – 6 samples are expected based on the varying soil conditions along the line. 5. Erosion control contractor team will install perimeter erosion control measures, typically construction fence, boundary fence, sediment control logs, rock logs, and vehicle tracking control per the requirements identified in the State Stormwater Management Plan (SWMP). 6. Only as necessary for project, trim and remove vegetation for off-site disposal that will directly impact site grading or access. PSCo to utilize trimming as much as practicable to keep root structure in place. 7. In areas where grading is required, strip topsoil (assume top 4 inches of soil) for reuse on site. Topsoil to be segregated from other material. Topsoil to be placed along access or in other areas adjacent grading. Topsoil may be transported from immediate work area due to space constraints. Topsoil that is 2 stockpiled for more than 14 days will be seeded for temporary stabilization. Topsoil stockpiles that are to remain dormant for more than 14 days are to have side slopes no steeper than 1H:1V. 8. Topsoil stockpiles may be placed on undisturbed adjacent ground. In this event, PSCo will place a separation fabric, i.e. Mirafi 140N or like, to provide a physical indicator as to where the stockpile ends and native ground begins. PSCo has had success with this approach as it reduces unwanted disturbance of native ground and allows an undisturbed but lightly ‘compressed’ topsoil layer to bounce back once topsoil and separation fabric is removed. 9. Once permanent cut slopes are graded, they will be covered in topsoil within 14 days and seeded and mulched within another 14 days. This will allow permanent cut/fill face revegetation to commence as soon as possible. Work areas where active construction is anticipated, i.e. flat pads, are not to be topsoil covered until heavy construction work has ceased. Once heavy construction of permanent pads has ceased, topsoil cover is to be completed within 14 days and seeding and mulching to follow within another 14 days. 10. Subgrade excavation material, from grading or structure excavation, will be spread on the access road, exported from the site for off-site disposal, or stockpiled in immediate or near-by work area for future use, particularly in areas with temporary grading impacts that are to have grades restored. Like the topsoil above, subsoil that is stockpiled on undisturbed ground is to have a separation fabric below the stockpile to clearly distinguish between native grade and stockpile material. This will minimize disturbance of the native grade and allow this compressed native grade to bounce back once stockpile and separation fabric is removed. 11. Once construction is completed at a site for permanent grading impacts, i.e. conductor pull/tensioning pads and access roads, the site soil is to be ripped to loosen the subgrade due to soil compaction during construction. Following decompaction, topsoil is to be placed at a depth of 4 inches in a loose manner ready to accept seed. Unlike most topsoil requirements, rock of various gravel sizes less than 6 inches diameter may remain in the topsoil layer. 12. Once construction is completed at a site for temporary grading impacts, the site rough grades are to be reestablished and the subgrade soil is to be bucket compacted to a ‘firm’ condition. Following compaction, topsoil is to be placed at a depth of 4 inches in a smooth but loose manner ready to accept seed. Unlike most topsoil requirements, rock of various gravel sizes less than 6 inches diameter is expected in the topsoil layer and is indicative of native topsoil in this area. 13. Soil amendments are to be added per soil analytic recommendations via mechanical broadcast or hydraulic application. Site seed mix is to be spread at appropriate rates given application type, hydraulic, drill, or hand broadcast. The amendment and seed application will vary substantially based on disturbance type site access and soil conditions. In cases of hydraulic application, the seed mix may be applied with the liquid amendment or hand broadcast but in no case is seed to be mixed and applied with mulch. 14. Final erosion control cover for seeded areas will vary based on access to disturbance areas. Truck or tracked access areas will have either straw crimp mulch (on grades less than 10 percent and low rock content soil) or a high quality hydraulically applied mulch, i.e. Flexterra HP-FGM or like, on grades exceeding 10 percent. PSCo generally does not support using erosion control blankets on this project due to concerns about reduced blanket to soil contact and due to longer life blankets having a high synthetic content with leads to a wildlife entrapment hazard. 15. PSCo will change erosion control inspection schedule from weekly to monthly inspections once initial stabilization measures (seeding and mulching) have been completed. If there are areas of concern 3 identified during the monthly inspection that need to be addressed (i.e. erosion or lack of revegetation growth), the revegetation contractor will return to the site to address identified issues. 16. Per the required State (SWMP) and local (Grading Permits), PSCo will continue to maintain structural erosion control measures across the project until no longer necessary. These will primarily include down-gradient sediment control logs but may include other control measures. These measures will be removed when no longer required and seed will be hand broadcast in areas where removal has exposed or disturbed less vegetated soil. 17. Once site has met plant density cover requirements, PSCo will perform a final post-construction site visit to document final conditions and then PSCo will close SWMP permit with the State. NOTES: • PSCo’s ability to stabilize disturbed areas with vegetation is dependent on many factors within PSCo control. Unfortunately, favorable moisture conditions for germination and continued growth are beyond PSCo control and a key determinate for revegetation. PSCo anticipates adequate revegetation will take multiple years. PSCo frequently returns to sites multiple times that are in the vegetation growth phase to address areas of erosion and reseed and/or mulch as necessary to promote vegetation stabilization. • PSCo hires a separate third-party company to perform the erosion control installation, maintenance, and revegetation as well as another third-party company to perform regular erosion control inspections. These companies have long standing relationships with PSCo. With this approach, PSCo has trained the installation company and inspection company to meet PSCo’s standards and to stay in compliance with state and local permit conditions which improve the restoration trajectory. Xcel’s practice is to continue inspection and maintenance, both performed by third party contractors, until site revegetation is established. Access for the post construction inspection and maintenance will be over prescriptive rights, land owner allowed access, and the transmission line easement. Seed Mix: The seed mix(s) will be identified as the project progresses and is typically developed based on site locale and existing vegetation cover. Introduct ion The Public Service Company of Colorado (PSCo), a Colorado corporation of Xcel Energy, is proposing to rebuild the Hopkins (HOPK) Substation – Basalt Substation (BASA) overhead transmission line in western Eagle County and eastern Garfield County, Colorado. This Noxious Weed Management Plan (Plan) is based on typical practices and not on a site weed survey. This Plan has been prepared to support the expected noxious weed management activities for the line rebuild within Garfield County. Section 2. Noxious Weed Management Requirements When present in large numbers, noxious plant species have had considerable impacts to the quality and integrity of natural ecosystems. Noxious weed species can alter fire ecology, successional ecosystem processes, and ecosystem function of the ecosystems they invade. Some species have had such serious economic and biological impacts that their control and management is mandated under Colorado State law (i.e., List A species). Because of the adverse environmental effects of noxious weeds, federal, state, and local governments have issued various orders and regulations regarding noxious weeds. The following are some of the regulations guiding noxious weed management. 2.1 Presidential Executive Order 13112 —Invasive Species Executive Order 13112, Invasive Species, was issued on February 3, 1999, to prevent the introduction of invasive species; provide for their control; and minimize the economic, ecological, and human health impacts that result from invasive species. This order directs federal agencies to prevent the introduction of invasive species, control and monitor invasive species, and restore native species and habitats that have been invaded (Federal Register 1999). 2.2 Colorado Noxious Weed Act As defined by the Colorado Department of Agriculture (CDOA), noxious weeds are plants that reduce agricultural productivity, lower real estate values, endanger human health and well-being, and damage scenic values (CDOA 2021a). The Colorado Noxious Weed Act §§ 35-5.5-101 through 119, C.R.S. as amended, states that an organized and coordinated effort must be made to stop the spread of noxious weeds. Rules pertaining to administration of the Act include a noxious weed list that designates and classifies noxious weed species into categories for immediate eradication (CDOA 2021a): • List A contains 25 species of noxious weeds targeted for eradication. If individuals or populations of A List species are found, the local governing body must provide the State Weed Coordinator with mapping that includes information on location and density of the infestation. • List B contains 38 species that are targeted for eradication, containment, or suppression based April 2026 Page 2 upon a given local governing body’s management plan. • List C contains 16 species for which the Commissioner of Agriculture, in consultation with the state noxious weed advisory committee, local governments, and other interested parties, will develop and implement into state noxious weed management plans designed to support the efforts of local governing bodies to facilitate more effective integrated weed management on private and public lands. In addition to the three lists, the state maintains a noxious weed species “Watch List”. It contains 19 species that CDOA has determined pose a potential threat to the agricultural productivity and environmental values of the lands of Colorado. It is for advisory and education purposes only and is intended to encourage the collection of information needed to determine if the species should be listed as a noxious weed. 2.3 Garfield County Noxious Weed Management Garfield County adopted a Noxious Weed Management Plan to reduce the prevalence of noxious weeds and their negative impacts. The Garfield County Noxious Weed List includes 41 weeds. The County has a Weed Advisory Board to support the County in yearly determinations regarding weed list changes. The County’s principles of weed management are incorporated into the pre- and post-construction weed management activities, as appropriate. These include: • Prevention • Cultural Practices • Physical/mechanical methods • Biological Control • Chemical Control The term “noxious weed” includes species listed as noxious by the Colorado Department of Agriculture (CDOA 2021a) and additional plants listed as weeds within the County. Plant nomenclature for noxious weeds in this report follow the CDOA website. Section 3. Noxious Weed Control : Pre -construction Prior to construction, Xcel Energy will utilize the following steps to minimize noxious weed propagation: • Training of crews as to how surface disturbance creates a more favorable environment for noxious weeds if seed stock s in the area, • Delineating areas with boundary fence, see SWMP Plans and report, or a similar physical barrier to limit unnecessary surface disturbance, • Cleaning of equipment to avoid bringing non-native soil or vegetation onto the site as these may contain unwanted seed stock. Equipment brought to the site must be free of clean of soil or vegetation from another site. Thorough power washing of wheels, tracks, undercarriage, and excavation equipment will be performed prior to site arrival. Equipment that leaves the site, i.e. for crew transportation or equipment repair, and then April 2026 Page 3 returns to the site without leaving pavement does not need to be rewashed. • A State Stormwater Management Plan (SWMP) permit that covers this construction activity will be obtained by Xcel Energy and the weed management steps will work in conjunction with the SWMP. Section 4. Noxious Weed Control : During - Construction Construction activities will expose soils in areas that have been previously disturbed and limited areas that have not been previously disturbed. This disturbance creates a potential for the introduction and spread of noxious weeds in the project area. Noxious weed species that occur in and adjacent to disturbed areas of the project have the potential to spread into areas impacted by placement of new poles, use and construction of access roads for construction equipment and use of staging areas. The goal of the plan is to minimize the spread of noxious weeds due to the proposed project’s construction activities. By implementing measures intended to minimize the spread of noxious weeds during construction and minimizing the establishment of new noxious weed populations post-construction, the proposed project should minimize new and help reduce existing noxious weed infestations. The activities during construction will, at a minimum, include: • Removal and stockpiling of topsoil for replacement in immediate area of excavation disturbance as this will create a more favorable soil strata for revegetation. • Leaving ‘drive & crush’ areas alone to rebound naturally. This assumes the topsoil layer and associated root structure remains in place but has only been compressed by construction activity. • Crews will continue to be diligent about minimizing the construction impact to avoid topsoil disturbance. • Hand or drill seeding of appropriate seed mix has been applied along with mulch. • The SWMP permit compliance will continue during construction and the weed management steps will work in conjunction with the SWMP. Section 5. Noxious Weed Control – Post -Construction Post-construction activities are based on the assumption that the site grades and topsoil have been restored and appropriate seed mix has been applied. Post-construction weed control activities will commence in the year following completion of construction as that is when weed seed germination and growth is more apparent. NOTE: Weed control will only be addressed in areas disturbed by construction and will not address weed infestations outside of the disturbance area even if they are within Xcel Energy’s ROW. Post-construction weed management priorities are based on the threat noxious weed species found in the project area pose to the overall goal of maintaining the health of the ecosystem. Generally, List A species are the highest priority because they are often the most aggressive species with limited distribution. List B are next priority species and List C species are generally widespread and are not prioritized. April 2026 Page 4 The best technique for controlling most established noxious weeds is an integrated approach of mechanical, biological, and chemical controls. Mechanical control usually involves mowing, hand-pulling, or cutting. Biological control is the use of organisms (usually insects, but also livestock) that are deliberately introduced to an area to control weeds. Chemical control involves the application of one or more herbicides at the appropriate time of the year (all herbicides should be applied by a certified applicator according to the manufacturer’s directions). Where chemical controls are recommended, Xcel Energy and its contractors work to minimize the use of chemicals that are harmful to beneficial insects in their vegetation management practices controlling shrubs, trees, and weed species within their rights-of-way and properties. This includes eliminating the use of neonicotinoids, a class of neuro-active insecticides, which have been found harmful to all invertebrate populations including bee populations and other native pollinators (Xcel Energy Undated). The year following construction, two noxious weed treatments will be undertaken, if necessary: 1. Early season (May-June) for cool-season noxious weeds (e.g., redstem fillaree, cheatgrass, bindweed), 2. Late season (July-August) for the warm-season noxious weeds (e.g., thistles and knapweeds). Areas of infestations identified in these surveys will determine appropriate treatment and suppression methods. Noxious Weed Treatment Measures Xcel Energy’s noxious weed management contractor will implement noxious weed control measures in accordance with existing regulations and local requirements. Post-construction control measures can include one or more of the following methods (that may be implemented during restoration activities): • Treatment methods will be based on species-specific and area-specific conditions (e.g., proximity to water or riparian areas, agricultural areas, and time of year) with the County coordinator being notified prior to noxious weed eradication activities. If areas are not seeded until the following spring, Xcel Energy will alter weed treatment timing based on weed control best practices. • Mechanical methods rely on equipment that can be used to mow or disc weed populations. If such a method is used in areas to be restored, subsequent seeding will be conducted to re-establish a desirable vegetative cover that will stabilize the soils and slow the potential re-invasion of noxious weeds. • Discing or other mechanical treatments, that would disturb the soil surface within native habitats, will be avoided in favor of an herbicide application, which is an effective means of reducing the size of noxious weed populations as well as preventing the establishment of new colonies. April 2026 Page 5 • Seed selection will be based on site-specific conditions and the appropriate seed mix identified for those conditions. • Herbicide applications will be controlled to minimize the impacts on the surrounding vegetation. In areas of dense infestation, a broader application will be used and a follow- up seeding program may be implemented. Refer to the Garfield County Noxious Weed Management Plan for recommended control techniques for noxious weed species. 5.1 Seed mix Restoration will consist of re-contouring the disturbed areas around poles and staging areas per grading plans and reseeding the area with the following seed mix. The timing of subsequent seeding efforts will be based on the life of applied herbicides, if used. NOTE: This seed mix will be reviewed during construction and in consultation with supplier and appropriate County representative. Table 1. Recommended Management and Mitigation Actions In addition to the specific management recommendations listed for each species in the Garfield County Noxious Weed Management Plan, the following mitigation measures are recommended (as appropriate) to minimize the spread of noxious weeds: • All construction equipment will remain in designated work areas. • The area of ground disturbance will be kept to the minimum necessary. • Minimize imported topsoil during construction. If importing is necessary, use certified weed-free soil. • All equipment will be thoroughly cleaned before entering and exiting the study area. • All mulches and straw used at the site will be certified weed-free. • All disturbed areas will be seeded after construction. Seeding will consist of species listed in Table 1. Semi-Desert Loam Seed Mixture will be spread on disturbed ground around poles and staging areas, as appropriate. The seed mix will be reviewed after the weed survey and in consultation suppliers and appropriate County representatives, as requested. • All seed mixes, soil, and other plant material used for revegetation will be free of noxious weed seeds, roots, and other propagules. • Only a Colorado-licensed Supervisor or Certified Operator will apply herbicides. • All herbicides will be applied in accordance with the manufacturer’s instructions. • Broadcast herbicide spraying will be limited to areas of project ground disturbance, around each existing and new pole, and at staging areas. Weed treatment around each existing and new pole will be limited to disturbance associated with this line rebuild. • The Garfield County Vegetation Manager will be notified prior to noxious weed treatments, as appropriate to the disturbance jurisdiction. • Applicable control measures (CMs) from the Stormwater Management Plan will be implemented. The 11-mile transmission line is proposed to be replaced following the existing line alignment. The proposed pole locations will vary from the current locations due to increased pole height, increased span, and more favorable pole siting but will remain within the current easement. The aging wood poles and steel lattice towers will be upgraded to new structures. While the pole diameters will increase due to the increased height and spans between poles, the number of new poles (75 proposed) will decrease compared to the number of existing poles (79 existing). The proposed transmission line pole locations and temporary construction impacts will have a de minimus impact on site drainage. There is limited permanent access and pad grading on the project and these localized temporary or permanent grading changes will not impact localized basin runoff as the impacted area’s overall grade and vegetated surface treatment will match pre-rebuild conditions. Drainage patterns and runoff will remain the same post-rebuild as pre-rebuild. It should also be noted that the span between the new poles averages between 500 feet to 1030 feet which reinforces the de minimus drainage impact. As detailed line design and construction approach continues to develop, the drainage impacts of this project will be reassessed and resubmitted as part of the pre-construction County Grading Permit. Even as the project details are refined, it is not expected that those changes would alter the expected findings of this Drainage Memo; no changes in drainage patterns nor changes in runoff. INTRODUCTION Public Service Company of Colorado (PSCo), a Colorado corporation conducting business as Xcel Energy, is proposing to rebuild the existing Hopkins to Basalt 115 kilovolt (kV) transmission line (Transmission Line 9256 Rebuild or Project) located in Garfield and Eagle Counties, Colorado. The existing transmission line must be rebuilt because it has reached the end of its operational life. The approximate 11-mile rebuilt transmission line will follow the current route connecting the existing Hopkins Substation, located northeast of Carbondale, to the existing Basalt Substation, located east of Basalt. This Public Outreach Summary includes a description of Xcel Energy’s approach to public outreach to date, including details about the Project’s community meetings held on October 12, 2022, and October 18, 2022. Xcel Energy organized the meetings to update the communities about the Project and anticipated construction methods, answer questions, and gather feedback. Th purpose of this Public Outreach Summary is to provide the following information: 1) an overview of public and jurisdictional outreach efforts conducted during Project planning; 2) the Project’s target audience and the methods used to notify the public of the community meetings; 3) the purpose and approach of the community meetings; and 4) an overview of the attendance and comments provided at the meetings. JURISDICTIONAL MEETINGS Xcel Energy first introduced the Project to Garfield County representatives in 2021 and has continued to meet with other applicable jurisdictions, including Eagle County and Bureau of Land Management (BLM) through the Project planning phase. These meetings focused on Project updates, concerns with potential rebuild locations and vegetation removal, planned geotechnical work, approach to community engagement and outreach, permitting requirements, Project schedule, and impacts during construction. Table 1 lists the county departments that have been engaged in Project discussions. PROJECT COMMUNICATIONS AND STAKEHOLDER OUTREACH FOR THE COMMUNITY MEETINGS Xcel Energy hosted community meetings on October 12, 2022, and October 18, 2022, to provide information about the Project, construction methods, schedule, and to solicit public feedback. Stakeholders considered during the notification period included landowners and occupants within a 500-foot radius of parcels crossed by the Project route. Prior to the community meetings, Xcel Energy corresponded with existing and future easement holders along the Project route to discuss the Project and any additional easements required. Outreach activities will continue through Project duration. NOTIFICATIONS FOR COMMUNITY MEETINGS Approximately 150 letters were sent to invite recipients to the community meetings and provided Project contact information. Letters were sent to all mailing and site addresses within 500-feet of parcels crossed by the Project and County representatives in September 2022 prior to the first community meeting on October 12, 2022. A copy of the letter notification and map are provided in Attachment A. Xcel Energy representatives also communicated directly with the venues in each town where events were planned to promote the community meetings. COMMUNITY MEETINGS The purpose of the community meetings was to provide a platform to inform key stakeholders, the interested public, and the media about the Project prior to the submittal of land use applications to Garfield and Eagle Counties, and to address questions and concerns posed by the public. Colorado Parks and Wildlife (CPW) has a statutory responsibility to manage all wildlife species in Colorado. This responsibility is embraced through our mission to perpetuate the wildlife resources of Colorado and provide sustainable outdoor recreation opportunities that educate and inspire future generations. CPW fulfills this mission by responding to requests for comments on wildlife impact reports, land use proposals, and consultations through public-private partnerships. CPW understands from the permit application material that Xcel is replacing 11 miles of 115 kV electrical transmission line from the Basalt substation to the Hopkins Substation in both Eagle and Garfield Counties over nine months between June 2023 and March 2024. Land ownership within this project area includes private, BLM Fisher Creek Recreation Area, and CPW’s Basalt State Wildlife Area. This Project is a part of a large-scale replacement effort in Western Colorado that has reached the end of its serviceable life. Single-pole, H-frame, and steel-lattice pole transmission line structures will be replaced with H-frame and 3-pole steel self-supporting poles, depending on local topography, within an existing 100 ft. right-of-way along the original alignment. Expected construction activities include ground crews, truck support, line-pulling stations, and helicopter operations with material stored between two staging areas. The project proponents briefly address construction erosion control BMPs and restoration efforts in the General Application materials. In reviewing the application material, the Project follows the existing alignment through scrub/shrub wildlife habitat. CPW has identified that this project area is located within the following CPW-mapped High Priority Habitats (HPH) with sound, spatial data and scientifically backed Best Management Practices (BMPs). To protect those habitats listed below, CPW recommends the following best management practices to avoid, minimize, and mitigate adverse impacts to sensitive species within the project area while incorporating logically based flexibility to accommodate the project construction because of its community benefit. Mule deer severe winter range and winter concentration area: part of the overall range where 90% of the individuals are located when the annual snowpack is at its maximum and/or temperatures are at a minimum in the two worst winters out of ten; and the part of the winter range where densities are at least 200% greater than the surrounding winter range. During construction and operations, the contractor should prioritize erosion control measures identified within the NPDES Permit to minimize off-site and in-channel sediment transport. Dust suppression should utilize fresh water only. Implement a Noxious Weed Recommendation Plan to treat topsoil stockpiles and materials at least biannually using a Colorado-certified herbicide applicator. In addition, the project proponent should spot-treat as needed to prevent any weed communities from seeding. Erosion control measures will be in place before any ground disturbance including clearing, grubbing, construction, and reclamation; survey work will be exempt. Traffic crossing the Native Species Conservation or Sportfish Management Waters should be restricted to a single crossing point to minimize damage to the banks and channel bed. Protect banks and streambeds by incorporating structure or mat reinforcements. Sediment collection mechanisms will be installed within the stream bed, including dry channels, and along the banks. Active Bald Eagle Nest or Roost site: defined as groups of individual trees that provide nesting habitat or diurnal or nocturnal perches and are usually the tallest available trees in the wintering area located primarily in riparian habitats. No permitted or authorized human activities within .5-miles of winter night roost or communal roost site from November 15 to March 15 if there is a direct line of sight to the activity; .25-mile if there is no direct line of sight. A Nest survey be performed in each project area (half-mile radius) no later than two weeks before initiating construction for each project location to identify potential raptor nests, perching, foraging areas, and winter roosting areas. Project construction managers should pause work if nesting or roosting behavior is observed within a .25-mile buffer around the location followed by a call to the District Wildlife Manager to discuss alternative plans. Helicopter activity near identified roosting sites should be avoided from November 15 through March 15 to avoid conflicts with roosting raptor activity. CPW State Wildlife Area - Basalt SWA: privately owned lands offering wildlife-related recreation to the public, paid for by sportspeople and managed under state law by Colorado Parks and Wildlife for the benefit of wildlife and hosts opportunities for the public to participate in shooting sports, hiking, wildlife viewing, hunting, etc. CPW understands the nature of the construction to include access roads, line pulling sites, staging areas, and structure pad development and will be accepted for this Project and is expected to develop and follow a robust reclamation plan. Due to hunting activity on Basalt SWA, construction crews should avoid work on Basalt SWA during hunting seasons from August to December. Basalt SWA serves as a wildlife sanctuary when snow levels are high during February, March, and April, and work during these months should be avoided if wildlife is present. Access through Basalt SWA will be allowed following a single travel route and keeping all gates closed. Protecting large landscapes that support such a wide variety of wildlife species and habitats that they utilize can only be accomplished by partnering with other land users, conservation organizations, and agencies. CPW recommends the following general BMPs that protect wildlife resources. Any clearing, grubbing, or stockpile materials will be managed to prevent sediment transport and may include seeding with cover crops, tackifier application, or mechanical controls. Noxious weed control will be required through chemical or mechanical treatment in any disturbed area using a Colorado-certified herbicide applicator. Any cleared vegetation or topsoil will be treated for noxious weeds and stored outside of the Native Species and Sportfish Management Water Buffer zone and include stormwater control measures. Notifications to pause or alter work will be at the sole discretion of the CPW District Wildlife Manager or Land Use Specialist and may be short or long-term in nature and will be the result of weather conditions or wildlife movement and other observations. District Wildlife Managers or Land Use Specialists will assess the situation, the impact, and the duration of the disturbance to develop alternative work plans. Project construction Managers will discuss upcoming weather events that may impact big game movements, accessibility concerns, or damage to the resources with CPW staff. Elk, deer, and other wildlife may not be hazed or moved off-site. Work can resume if the presence of big game is not detected for 24 hours. Dogs will not be allowed at the Project location. Remove trash and debris daily. Lighting should be capped from above to help reduce night-sky light pollution to avoid interference with nocturnal wildlife behavior. Conduct work during winter daylight hours, between 7:00 a.m. and 5:00 p.m. to minimize disturbance to wintering elk, deer, and other wildlife that utilize this area. The flight path for the helicopter should be kept within the construction easement corridor to reduce additional disturbance as much as possible. Helicopter work should avoid any wildlife spotted in the area and limit sightseeing diversions.
