The undersigned (whether singular or plural hereinafter referred to
as I) hereby . apply for a water service connection to provide water service
to the property described below from the West Glenwood Springs Water District
" main, .which main takes water from the City of Glenwood Springs water system
and in consideration of such water service connection, and contingent
upon approval thereof by West Glenwood Springs Water District (hereinafter
• called Water District), and the City of Glenwood Springs, Colorado (herein-

as being a material inducement to permit such connection:

3. I do hereby set over, assign, transfer and quitclaim unto the City
a proportionate share of the irrigation water rights and ditch rights used
. upon and appurtenant to the land above described, if any, excepting and
- reserving for the use and benefit of the above described land the right
and privilege of continuing in the free and uninterrupted use of such water
and water rights solong as the undersigned, or any subsequent user of such
• land, shall continue in the use of such water for irrigation or other
beneficial purposes upon or connected with said land, and shall continue
• to pay maintenance costs or otherwise prevent said water and ditch rights
from being lost and abandoned.

4. I hereby ratify, confirm, accept and approve and promise and agree
to be bound by the several. terms and conditions of contract dated August
• 29, 1958, recorded in Book 311 page 287, office of the Garfield County
Clerk and Recorder, between the District and the City, and further
covenant and agree that the terms and conditions thereof, to the extent
- applicable, shall he and constitute covenants running with the above
described property hereby declaring that I have read and understand the
several terms and conditions thereof.
• 5. I do hereby grant unto the Water District and unto the City an ease-
ment for the continued use, installation, maintenance and operation of.

•any part of the said Water Distribution System extending to and including
the curb box, and further consent that the agents and representatives of
the City and The District may enter upon the premises served thereby
• for inspection purposes to insure compliance with water service ordinances,

regulations and laws.
6. I acknowledge receipt of copy of Rules and Regulations of Water
District dated July 8, 1971 (copy of which are attached hereto) and
further acknowledge and represent that I have read and understand the
same and agree to be bound thereby.
I hereby represent and warrant that I am the owner of the above
described property, or am authorized and empowered to act as agent for
and on behalf of such owner or owners in the execution of this application.
8. I further covenant and agree that the water service facilities
above described will not be extended, enlarged or connected with additional
water facilities, and particularly I expressly covenant and agree that no
cross- connections shall be made with other water supply systems, except
after notification to the City and the District, and obtaining consent
therefrom.
9. I further acknowledge that I fully understand that water service,
• and the connection therefore,shall be subject to termination for violation
of the: terms and conditions prescribed under the said Water Service Agree-
ment. dated August 29, 1958, the Rules and Regulations of District attached
hereto, as well as other regulations, ordinances and laws affecting out -of
City water users and also to such other penalties and forfeitures as may
be prescribed for such other out -of -City water users.
