Dear Steve:
I understand that you will be preparing a new Deed of Trust relating
to property owned by J. Howard Boies and Elsie S. Boies.
In 1969 Mr. and Mrs. Boies became joint tenants under a deed recorded
in Book 400 at page 298 of the following described tract of land
WYNE and NIINEaNW4SE1/4 of Section 25, Township 5 South, Range 92
West.
It so happens that the NINEkNW,SE; is the same as tract 35 of the
recorded plat of Antlers Orchard Development Co.
Because of the fact that tract 35 falls within a prior recorded
subdivision I think that such a description should hereafter be
used in order to avoid any SB 35 problems.
Last year the Boieses wanted to sell a 5 acre tract to their sister
and brother -in -law and at a Board of County Commissioners meeting
on June 19, 1972, obtained an SB 35 exemption as to the EkSW4NEiSE1/4.
::' Last Friday, Mr. Boies asked me to prepare and give him a legal
description of the land which he now owns. I gave him a description
as follows:

The above description is perfectly correct. However, as you may
know Mr. Boies has another petition pending before the Board of

16, with respect to that application and if it is granted I under-
. stand that Mr. Boies will then execute a Deed to his daughter,
Sharon Medina conveying the WhSW4NE'SE4.

Because of the fact that this WISEaNE4SE; may be partially released
from the Deed of Trust which you are presently preparing it might
result in more clarity if you would use the following description
concerning the Boieses current ownership of 20 acres.

Re; Correction Warranty Deed
Dear Mr. and Mrs. Boies;
Pursuant to your request I have prepared a Correction Warranty
Deed which is enclosed herewith. This document should be signed
by both of you as well as Mr. and Mrs, Swapp and should likewise
be acknowledged by both of you and acknowlegded by the Swapps
before a notary public. When you have it signed and acknowledged
return to me and I will arrange for the correct recordation
thereof. The County Assessor wants an address indicated on the
Deed or on the back of it indicating to whom the county tax bill
should be sent. Kindly have the Swapps write in, on the back of
the deed, the address to which they want the tax bill sent in
the future.
I am also enclosing a self - explanatory xerox copy of a letter I
have sent this date to Mr. Stephen Carter, Attorney at Law, in
Rifle, whom I understand will be preparing the new Deed of Trust.
I presently have the abstract to your property. However, I am
going to return the abstract to the Bank of Glenwood this after-
noon. If Mr. Carter needs the abstract he can obtain it from
the Bank of Glenwood.
