INC. have requested me to inform you of two major problems developing with your building project. 1. You are presently constructing a retaining wall over the 20 -foot water easement which crosses your property. According to easement restrictions, no structure is allowed to be built across or to encroach upon easements. I am enclosing a copy of a recent correspondence to all Shareholders of Record regarding the easement. 2. As per the special meeting of the Board of Directors at a special meeting on 12/8/81 at Niemann's Garden Center, approval has been given by the Board present at the meeting, for your retaining wall to he built across the easement, but we must have a letter and a right of encroachment filed of record showing that you and all future owners of your property will sustain any costs of repair to said wall caused by the necessity of MITCHELL- COOPER DITCH & PIPELINE CO. INC. to repair said water line and any additional costs sustained by the company created by the encroached wall's hampering the ease of repair and requiring additional costs of maintenance and repair. 3. Regarding the necessity of the fire plug, we refer you to the letter from the Glenwood Springs Fire District Fire Chief stating the need for additional fire plugs to protect your new construction. The pre- cedent regarding necessity of upgrading fire protection by installing fire plugs to cover the building is the responsibility of the property owner.
