These copies and their contents fulfill the "information needed" requirements as set forth in the letter of August 19, 1974 by Mr. Lamont Kinkade of this office. Also find attached Mr. Huebinger's completed permit #75 for the new individual home sewage treatment system on said property. This docu- ment fulfills all the "intent to comply" requests in Mr. Kinkade's letter of August 19, 1974 and brings said system into full conformity with present Colorado State and Garfield County laws and requirements. Director Garfield County Environmental Health 2014 Blake Avenue Glenwood Springs, Colorado 81601 Dear Lamont: In answer to your letter of August 19, I specifically reply as follows: (1) It was I who was completely responsible for the installations of this system. My phone number is 945 -6619. (2) The system was installed around the 13th of June. The installa- tion was made by digging a hole some 7' deep and 25' long and 10' wide with a 175 front end loader. The septic tank, sand baffle and drywell were then placed. Proper gravel and hay were thenplaced around drywell as evidence by exposure to Mr. Feld on 8/24/74. (3) Copy of invoice is attached with what components were installed. (4) The information you requested has been put on my improvement survey. I have attached a copy. (5) At the time of installation, I was only extending the existing system and didn't feel an additional permit and perc tests were necessary. Items 1. through 8 of your instructions to comply have been accomplished. I hope this gives you all the information you requested to satisfy the State and County regulations. Dear Mr. Hubinycr: It has recently come: to our attentiour that, you are the owner of Lot 23 in Westbank S:.ibrlivision (0235 Oak Lane) , and that .is the owner, you did knuwi_ngly and purposely : o]ate and/or cruse numerous violations of the Garfield County Individual Sewage Dispcsa] Regula- tion and the Colorado State "Guidelines For Individual Sewage Disposa as adopted pursuant to C.R.S. 66 -44 as amended. The specific violations are as follows: 1. Failure to obtain permit 2. Failure to obtain pert test 3. Failure to obtain licensed installer 4. Failure to obtain required inspection 5. Failure to submit design 6. Possible additional violations yet to be determined subsequent to court action. Therefore, formal charges are being drawn up against you for each of the above counts at this time. Each of these counts carries a possible penalty of $500.00 and /or six months in jail. However, since our }rime concern is for achieving adequate voluntary compliance with health and pollution regulations rather than obtaining fines, we are withholding the filing of these charges for ten (10) days in the hopes that you will provide us with the following information and indication of intent to comply. Information needed: 1. A siy_neFi statement (tom you as to who the installer or person responsible for the installation was. His name, address and phone number. 2. An improvement survey showing the exact location of the illegal system in reference to water line, drives, foundations, property lines, etc. 5. A statement from the installer as to his exact involvement and reasons for his actions. Indications of intent to comply: 1. Apply for sewage disposal permit and perc test $75.00. 2. Uncover all component parts of system for proper inspection (presently uncovered). 3. Prepare one perc hole at depth of proposed absorption if a drywell (see packet attached). 4. Prepare one soil profile hole to a depth at least 4' below the bottom of the absorption system. 5. Call for perc test. 6. Obtain permit and post at site. 7. Request inspection of system for compliance with permit. 8. Upon final approval, cover system and place in use. Once you have provided the above and met all the requirements of the State and County Regulations, you will be informed of the dismissal of all charges.
