We have previously given you a Temporary Certificate of Occupancy ( #2518 -April 10, 1995) to enable you to live in the home pending completion of 5 items contained in the Agreement you signed. (A copy of this agreement is enclosed). When I spoke with you previously, it sounded as though items #1 through #4 on your agreement have been completed. That leaves item #5 remaining. There is no guarantee that the Special Use Permit will be granted. STEP # 1 - PURCHASE NECESSARY WATER FOR SECOND DWELLING UNIT. Mr. Dwight Whitehead, of the Colorado Division of Water Resources told me you had contacted him. A copy of the current well permit for your property indicates that you are only approved for water usage for a single family dwelling. Therefore, you need to purchase additional water from the Basalt Water Conservancy District to have a water supply for a second dwelling unit on your property. STEP #3 - OUTCOME OF STEP #2 Pending the outcome of step #2 above will determine the final resolution of your still open building permit. IF THE SPECIAL USE PERMIT HAS BEEN GRANTED, YOU MAY KEEP THE SECOND DWELLING UNIT. WE NEED TO DO A FINAL INSPECTION, AND ISSUE A CERTIFICATE OF OCCUPANCY FOR THE SECOND DWELLING UNIT. IF THE SPECIAL USE PERMIT IS NOT GRANTED, then you will need to remove various items in the second dwelling unit, as detailed in the agreement you signed. I would ask that you initially contact me by Friday, August 25, 1995 with your initial plan for compliance. Resource Engineering, Inc. (RESOURCE) is the engineer for the Basalt Water Conservancy District (District). Ms. Mann currently has a water service contract with the District for 0.70 acre feet per year and 0.033 cfs (contract no. 3.3.5.78a). The contract covers one single family home on Lot 4 located in the NE'/a, SW'/, Section 31, Township 7 South, Range 87 West, 6th P.M. Ms. Mann has contacted RESOURCE to request an amendment to her contract which would increase the contract amount to include the addition of an attached apartment to her existing home. An amendment of this type is typically approved by the District's Board of Directors and it is our opinion that Ms. Mann's request would also be approved. Also, refer to information contained in the plans prepared by Functional Designs Limited, Job No. 1494; also, stamped and signed drawings from High Country Engineering, Inc., for the Mann residence. The structural drawings show that the foundation design is based on the soils report by Chen Northern, Inc., project No.4- 1- 92 -94, dated February 22, 1994. The plan shows that all of the recommendations in the soils report will need be implemented. The Garfield County Building Official will need a copy of this soils test at the time this permit is issued. Any changes made in the foundation plans as shown will need to be coordinated with the P.E. and the Garfield Building Official. G -9 It is our understanding that the owner desires to construct the house for himself and therefore does not need a general contractor. However, it is the duty of the owner to notify the Building Dept. when the construction is ready for inspection. Schedule the inspection at least one day before such inspection. All work is subject to inspection prior to any cover up, (section 305, entire section of the U.B.C.) Coordinate inspections of the septic system and leach field prior to any cover - up. (Refer to the U.P.C. and the State Plumbing Laws). G -14 All grading on site must comply with chapter 29 and 70, of the U.B.C. (i.e., maximum slope of cuts and fills, etc.) Provide adequate drainage away from the structure at all locations around the building (use section 2905 (f) and section 2907 (5) of the U.B.C.) G -19 Locate all utilities for line locations and approval prior to beginning any excavation on site (water, electric, telephone, etc.) G -20 Submit all or any special reports (i.e.: soils tests, compaction reports, and engineered drawings from Architects or Engineers) keep in mind that the Building Official may ask for special reports from time to time, as deemed necessary per. A self closing, tight fitting solid wood door 1 3/8 inches in thickness will be permitted in lieu of a one -hour fire assembly, (Section 503 (d)., exception 4. U.B.C.) B -12.1 In order to achieve the one - hour fire resistive construction between the garage and office portion (horizontal separation). In accordance with the N.E.R. Report No. 200. R.C. channel (hat channel) at 16 inches must be applied perpendicular to the T.J.I. members ahead of 5/8 inch Type X drywall. (Refer to page 14 of 14.) B -16 Provide premises identification which is legible from the street in accordance with, (Section 513, U.B.C.) B -23 Provide smoke detectors in accordance with (Section 1210, of the U.B.C.) One smoke detector is required on each level and they shall be inter connected. Audible from the bedrooms with the door closed. Also one will be required at the high point in the living room, loft area, B -27 Vent fans are required in each bathroom, note the laundry room is also required to have ventilation capable of providing five air changes per hour and connected directly to the outside, (Section 1205 (c)., U.B.C.). B -29 The contractor needs to be aware of (Section 1204 of the U.B.C.), when ordering windows. Each sleeping room shall have at least one window or door which may be used for escape or rescue.
