1. Garfield County has adopted the '1988 Uniform Building Code (U.B.C.) as the law regulating
all building construction in Garfield County. This resolution is referred to as the "Garfield County
Building Code Resolution of 1990"
2.PURPOSE OF THE BUILDING CODE - Section 102 of the 1988 UBC states "The purpose
ofthis cod is to provide minimum standards to safeguard life or Iimb, health, property and public
welfare by regulating and controlling the design, construction, quality of materials, use and
occupancy, location and maintenance of all buildings and structures within this jurisdiction
(Garfield County), and certain equipment specifically regulated herein.
3. SCOPE OF THE UNIFORM BUJILDING CODE - The provisions ofthis code shall apply
to the construction, alteration, moving, demolition, repair and use of any building or structure
within this jurisdiction (Garfield County), except work located primarily in a public way, public
utility towers and poles, mechanical equipment not specifically regulated in this code, and
hydraulic flood control structures.
4. SCOPE OF UBC FOR ADDITIONS, ALTERATIONS OR REPAIRS TO EXISTING
STRUCTURES - Sec.104 (b) states in part "Additions, alterations or repairs may be made to any
building or structure without requiring the existing building or structure to comply with all the
requirements of this code, provided the addition, alteration or repair conforms to that required for
a new building or structure. Additions or alterations shall not be made to an existing building or
structure which will cause the existing building or structure to be in violation of any of the
provisions of this code nor shall such additions or alterations cause the existing structure to
become unsafe."
5. MAINTENANCE - Sec.104(d) All buildings and structures, both existing and new, and all
parts thereof, shall be maintained in a safe and sanitary condition. All devices or safeguards which
are required by this code shall be maintained in conformance with the code edition under which
installed. This owner or his designated agent shall be responsible for the maintenance of
buildings and structures. To determine compliance with this subsection, the building official may
cause any stricture to be reinspected.
6. PERMIT REOUIRED - Sec. 301(a) states " Except for exempted work(see below #7)...no
building or structure regulated by this code shall be erected, constructed, enlarged, altered,
repaired, moved, improved, removed converted or demolished unless a separated permit for
each building or structure has first been obtained from the building official.
7. EXCEPTIONS - There are a few exceptions to needing a building permit. The most common
ones are (1.) One story detached accessory buildings used as tool and storage shed, playhouses
and similar uses, provided the projected roof area does not exceed 120 square feet. (2.) Fences
not over 6 feet high. (3.) Platforms, walks and driveways not more than 30 inches above grade
and not over any basement or story below. (4.) Painting, papering, and similar finish work. (5.)
AGRICULTURAL BUILDINGS - From the resolution adopting the UBC, "Buildings or
structures used for the sole purpose of providing shelter for agricultural implements, farm
products, livestock or poultry shall be exempted from regulation" by the 1988 UBC. (See separate
handout on Agricultural Buildings for more information).
