A RESOLUTION OF APPROVAL FOR A LAND USE CHANGE PERMIT FOR
MATERIAL HANDLING TO ALLOW FOR CONVERSION OF. THE 12A-24D
PRODUCTION WELL INTO A PRODUCED WATER INJECTION WELL AND TO
PERMIT LOCATION OF TEN (10) 500 BBL STORAGE TANKS ON THE SITE. TIDS
FACILITY WILL BE LOCATED IN THE NW Y. OF SECTION 24, TOWNSIDP 6
SOUTH RANGE 97 WEST OF THE 6m P.M., GARFIELD COUNTY
PARCEL NO# 2411-013-00-001
Recitals
A. The Board of County Commissioners of Garfield County, Colorado, received a
request for a Land Use Change Permit for Material Handling to allow for conversion of the 12A-
24D production well to a produced water injection well and storage often (10) 500 BBL storage
tanks as shown in the attached site plan, Exhibit A.
B. The injection well and storage tanks will be located within a 5,116-acre parcel ofland
owned by Puckett Land Company described in a Warraoty Deed recorded at Book 794 at Page
498 in the office of the Garfield County Clerk and Recorder.
C. The subject property is contained within unincorporated Garfield County in the
Resource Lands -Plateau Zone District and located six (6) miles northwest the Town of
Parachute offCR 215.
D. Material Handling requires a Land Use Change Permit through a Limited Impact

. 2. Prior to issuance of the Land Use Change Permit the Applicant shall obtain all required
federal, state and local permits. Prior to issuance of the Land Use Change Permit the
Applicant shall provide information regarding the potential levels of emissions that will
result from this use to Building and Planning and any air emission permits that may be
required from CDPHE shall be provided once issued.
3. Prior to issuance of the Land Use Change Permit the Applicant shall provide a list of
equipment that will exist on the site in operation of this use, as well as permits that may
be required for that equipment. This includes, but is hot limited to, air permits.
4. Operation of the facility must be in accordance with all Federal, State and Local
regulations and permits governing the operation of this facility.
5. Industrial activities shall
be required to comply with the following staodards:
(1) The volume of the sound generated shall be so operated that the volume of sound
inherently and recurrently generated does not exceed the Statutory requirements;
(2) Vibration generated: every use shall be so operated that the ground vibration
inherently and recurrently generated is not perceptible without instruments at any point of
any boundary line of the property;
(3) Emissions of smoke and particulate matter: every use shall be so operated so as to
comply with all Federal, State and County air quality laws, regulations and staodards;
( 4) Every u8e shall be so operated that it does not emit heat, glare, radiation or fumes
which substantially interfere with the existing use of the adjoining property or which
constitutes a public nuisance or hazard. Flaring of gases, aircraft waniing signals,
reflective painting of storage tanks, or other such operations which may be required by
law as safety or air pollution control measures shall be exempted from this provision.
6. Prior to issuance of a Land Use Change Permit the Applicant shall provide information
regarding stormwater and erosion control measures to the Building and Planning
Department for review and acceptance.
7. Prior to issuance of a Land Use Change Permit the Applicant shall provide a Spill
Prevention, Control and Countermeasure Plan that contains adequate information
regarding containment of a minimum of 110% of the fluids proposed to be stored on the
site. This plan shall be submitted to the Building and Planning Department for review
and acceptance.
8. Wildlife mitigation measures and Best Management Practices imbedded within PDC's
CDOW approved Wildlife Mitigation Plan(s) shall be adhered to and considered specific
conditions of approval.
9. All exterior lighting will be the minimum amount necessary and all exterior lighting will
be directed inward and downward, except that provisions may be made to allow for
