II . pHSCR !PT!ON OF TUB PRO?OSAL It is proposed to amend the approval givei# fof.ihe Sopris RV Park PUD by Resolution No. 88-045.(See resolution pg. • The PUD plan approved a total of 32 RV/tent spaces, with water and sewer services available to 13 spaces and the remaining 19 spaces would have just water service available to them. The applicants propose to amend the PUD plan to allow far 27 spaces to have water and sewer service, along wilh a manager's and caretaker's residence. Wben this R V Park WM built, \he original owrer illegally provided sewage hookups to a lola! of 27 spaces and a total of 37 spaces. The applicants bough\ the property and have continued to use the lSD system as it was installed. As a result of a visual inspection of the park last fall it was determined !hal there were over 4lJ RV's in tbe facility . A letter of zoning violation was sent to the owners, after which it was determined that the ISDS had been illegally hooked up to more than the approved 13 spaces. The applicants have agreed to remove the illegal R V's and additional spaces to conform with the original PUD approval or 32 spaces, and increase the .. 1- number of spaces having full waler and sewer service to 27 spaces. IlL MAJOR ISS!IIJS AND CONCllRNS I. ~: Section 4.12.03 slates, "All those provisions of the Plan authorized to be enforced by \he /County mily be modified, removed or released by the County subject to 1he roll owing: (I) No moUiliea1ion, removal or release of the provisions of the Plan by lhe Counly shu\\ affect the rights of the residents, occupants and owners of lhe PUD to maintain and enforce those provisions at Jaw or in equi\y; ami (2) No substantial modifications, removal or release of the provisions of the Plan by I he County shall be permitted except upon a findinB by the County, foHowing a public hearing called and held in accordance with the provisions of Section 24-67-104, C.R.S., that the modification, removal, or release is consistent with the efficient development and preservation of the entire PUD, does not a IT eel in a substantially adverse manner either the enjoyment of land abutting upon or across a street from the PUD, or the public interest, and is nol granted solely to confer a special benefit upon any person. The aprlicant is requesting that the 13oard modify the original PUD approval to allow for more spaces with full hookups. The use of {SDS for the park has ulways been an issue and one of the reasons for limiting the number of spaces was the Town of Carbo11dale's concern over the potential for this site to be used for long tenn occupancy. The PUD limited the stay of an RV to eight (8) months in any one calendar year. It appears that there are tenants that have been in the park for more than the maximum a1\owab1e stay. 2. ISDS Re~ulutiofili: Another [larl of this request is to altow for two(2) ISD systems that combined will exceed 2000 gpd. Normally, \he lSDS regulations do not allow for one or more systems on a piece of property \o exceed 2000 gpd without getiing a site approval from the Colorado Department of Health. The State has a policy that does allow for more than one system on a piece of properly that combined, exceed 2000 gpd, ifthey can meet the separation requirements from properly lines, buildings and other \SD systems. This policy is an internal office interpret·ation of the regulations. In a verbal conversation with lhe Stale Helllth Department in Grand Junction, they indit.:ated that the interpretation does not apply to areas with physical access to a central sewage disposal facility. The Carbondale Sanitation District facilities are across the river. The State did not approve \he sHe application in 1988, due to the accessibility of the Carbondale facililies. The applicant's engineer has submitted applications for two separate lSD sy:;tems that would meelthe separation requirements to m_eet _the prevj.j~~~.Y~ noted policy of the Slate Department of Health. That lhe meeting before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were submitted and all interested parties were heard at lhe hearing. 2. That the proposed PUD plan amendment is generally consistent with the Garfield County Comprehensive Plan. 4.
