PARK PLANNED UNIT DEVELOPMENT REZONING AND APPROVAL OF ITS PLAN WHEREAS, Stanley and Valerie Koziel requested that the Board of County Commissioners of Garfield County, Colorado, consider the modification of the approval of the Sopris R.V. Park Planned Unit Development rezoning and its Planned Unit Development plan contained in Resolution No. 88-045; and WHEREAS, the Garfield County Planning Commission recommended approval of the proposed rezoning and plan, subject to certain conditions of approval; and WHEREAS, a public hearing was held by th.is Board on July 17, 1995; and WHEREAS, based upon the evidence, sworn testimony, exhibits, study of the Comprehensive Plan for the unincorporated areas of Garfield County, comments from the Garfield County Planning Department, recommendation of the Garfield County Planning Commission, and comments from all interested parties, th.is Board flnds as follows: l. That proper publication and public notice was provided, as required by law for the hearing before the Board; 2. That the hearing before the Board was extensive and complete, that all pertinent facts, matters and issues were submitted, and that aU interested parties were beard at the hearing; 3. That the Garfield County Planning Commission has recommended to this Board that 484097 B-955 P-352 10/10/95 11:21A PG 2 OF 4 the requested PUD zoning and piau change be granted, provided that certain condition be imposed upon the applicant; 4. That the proposed zoning is in general compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated area of the County; 5. That the requested zone change amendment and PUD plan approval are in general compliance with all requirements of the applicable Garfield County Zoning Resolution and; further; that the· requested· PUD· is-suitable and· appwpP..ate-for. the-subjec:L property, given the location, condition and circumstances of the property, and it is generaJJy compatible with eiliting land uses in the surrormding nearby area; 6. That other than the foregoing particu1ars, the requested zone change amendment and plan approval herein is suitable and appropriate for the subject property concerning the location, condition and circumstances of said property and is in the best interest of the morals, order, health, safety, convenience and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Garfield County, Colorado that the request for a modification of the Sopris R.V. Park PUD Plan and Text approval contained in Resolution No.88-045 be approved and modified as follows: 1·. Tnatall·representrtit1D1rof-!:he-applicant shall be·considered·conditiou& of a-pproval; unless approved otherwise by the Board of County Commissioners. 2. That the applicant install the proposed individual sewage disposal systems as proposed and that the applicant's engineer certify that the systems have been installed as designed and are connected to a maximum of27 RV spaces. At such time that a sewer lone is available on the same side of the river, if one or both ISDS fail, the RV park will connect to the Carbondale sewage treatment facilities, if available to the site. 3. That the applicant will submit a Jist of the license plate numbers and registration state for each R V in the park, every three (3) months, to the Planning Department and insure that no RV stays in the park for more than eight (8) months in any calendar year. Further, that the applicant will allow the Planning Department to audit the registration records of the park at any time, with no advance notice required. 4. That the applicant will comply with all conditions of approval and the provisions of the PUD zoning contained in Resolution No. 88-045. 5. That the applicant be required to reestablish the landscaping plan and to mrunlain the landscaping and that the landscaping be gtt.aJQ.nteed to surviveorto replacetbemateriaJ that dies. 6. That the applicant obtain either a letter of approval from the Colorado Department of Health for the proposed ISDS or a statement that the Colorado Department of Health has no jurisdiction over the proposed method of sewage disposal. 484091-B-:-955-P-353. 10/10/85.
