Receive email from Cassie requesting I contact property owner
at 970-618-5438 in regard to complaint on neighbor cutting/grading roadway on adjacent parcel through to Remington Street. Dale Cruse answered when I called and told me about neighbor
behind his house that is doing all the grading on what assumed to be Winchester Street. I said I would investigate on Thursday April 12 in AM. Checking original plat dated 1964, I find
a plat note stating all roads, alleys, and utility easements dedicated for public use. Winchester Street is not on the 2012 GARCO road index. All other streets in Rifle Village South
appear to be on the index.
Upon arrival I found someone has cleared a portion of the ROW/easement for Winchester and open a road connection from 244 Winchester (Loren Woody property)
through to Remington. The grading continues into back yard of 244 Winchester and uphill to what appears to be the back property line adjacent to an irrigation ditch on top of slope.

Went back to 244 Winchester to place Stop Work Order on porch post in plain view of driveway. Received phone call from Diane Woody later that day
and we agreed to meet following Monday.

Spoke with Wyatt Keesbery at R&B. He says he did speck with Diane Woody back in November and told her Winchester is not a County
road and that Woodys would need approval from surrounding property owners before doing any work on private road. Wyatt thought that Harry Coleburn was the person responsible for irrigation
ditch above Rifle Village South and mentioned there was a ditch failure a few years ago. It sounds as though that may have been the same time that Dale Cruse requested building a berm
behind his property to protect against another similar event or severe storm runoff. This would explain the topography behind Cruse property were Winchester ends at this property line.
Meet
with Diane Woody to discuss SWO and Grading permit. She also mentioned something about a ditch failure sometime ago and that the ditch had been lined since then to contain it. According
to her the ditch had eventually been abandoned.
In the end we agreed that there was more information needs to be included on the grading permit and that work on Woody property should
be phase one with any work on Winchester be done as phase two after Road and Bridge, Fire District and B&P staff had reviewed that work to determine if proposed grading plan is sufficient.

Discussed this issue during staff meeting and it has been decided that the County will not be involved in any form with the Winchester road work; this is a civil issue.
We will issue a grading permit for work on Woody’s property at 244 Winchester and nothing else.
April 19
Received call from Diane Woody and told her we would permit grading on her
property only. Anything to do with work off site is b/t her and neighbors. She says a grading permit should be submitted by week of April 23.

Left message with Dale Cruse
to give status of staff decision to permit work on Woody parcel only. Any work off site would be agreed to by neighbors and county will not be involved.
