SBA Towers II owns the tower and leases from the landowners, Mr. and Mrs. Richard and Karen Rhoads. Union has entered into a lease agreement with SBA Towers II in order to collocate at this site. Along with the building permit are: • Two (2) copies of the construction drawing; • Union Telephone's redacted lease agreement; • SBA Towers II lease agreement; • A letter signed from the Rhoads indicating approval for any future building inspection; • Check number 259707 in the amount of $41 .05 for the permit. The project entails placement of a concrete pad with a metal frame canopy, an ice bridge spanning from the canopy to the monopole tower, placement of an outdoor electronic equipment cabinet, antennas placement on the tower and coax from the cabinet to the antennas. Please review this document to determine if you have adequate information to design your project and to facilitate a plan review. COMMERCIAL OR MULTI-FAMILY BUILDING PERMIT APPLICATION CHECKLIST This checklist is to be used with all commercial or multi-family construction. APPLICATION FORM: Please make sure the following information is provided on the application. Parcel number obtained from the County Assessor's Office. • Job address (assigned physical address). Legal Description: lot, block, filing, subdivision or tract, section, township and range. • Owners name, mailing address, phone, fax, or cell. • Contactors name, mailing address, phone, fax, or cell. • ArchitecUEngineer's name, mailing address, phone, fax or cell. • Building size, height, number of stories, lot size. • Use of building (commercial) Class of Work (new, addition, alteration, repair, demo, move, other) Description of work. • Type of heating (natural gas, propane, electric, other) • Sewer system (Community or 18DS), also see other items below. Garage (attached or detached) • Driveway permit (please see other items below) Valuation (labor and materials) OTHER ITEMS: If you anticipate obtaining a water-tap from the City of Rifle, please provide a letter indicating that the City will provide water service. (Required to submit building permit application). 18DS requires a septic permit application to be submitted with the building permit application. • A separate electrical permit must be obtained from the State of Colorado Electrical Board. Prior to submittal of a building permit, you are required to show proof of legal and adequate access to the site. This may include proof of right to use a private easement, County Road & Bridge permit, or Colorado Department of Highway permit, including a Notice to Proceed. The County Road & Bridge Department can be reached at 970-625-8601. If you anticipate excavating or grading prior to issuance of a building permit, you will be required to obtain a separate grading permit. • If you belong to a Homeowners Association (HOA), it is your responsibility to obtain written approval, if required. • Provide copies of any Resolutions and/or Land Use Permits associated with this property. • Projects with more than ten (10) occupants require plans sealed by a Colorado Licensed Design Professional. Occupant load shall be calculated by IBC Table 1004.1.1. • A Colorado 8tate Licensed Electrician and Plumber must perform installation and hook-ups. • Commercial projects require a copy of the plans be submitted to the local Fire District for review. BUILDING PLANS: Two (2) sets of plans must be submitted. Plans must be 18"x24" minimum size, complete, identical, legible, and to scale. Commercial projects also require a copy of the plans be submitted to the local Fire District for review prior to permit issuance. All plans will be checked at the counter for completeness. If any of the required information is missing, the building permit application cannot be accepted. SITE PLAN: Please make sure the following information is provided on the site plan. Property address/legal description. o North Arrow and Scale on each page. Show all property lines, building envelopes, flood plain, and easements. o Provide setback distances from boundaries, buildings, septic, well, and waterways. o Location and direction of the county or private road and driveway accessing the property. Proposed and existing structures include sheds, barns, decks, patios, and any other buildings. o Existing and proposed grade, positive drainage around structure (to be contained on site). Streams, rivers, creeks, springs, ponds and ditches. o EXisting and proposed wells, septic tanks, leach fields, and other systems. (if applicable) o Retaining walls (engineer stamped detail required for walls over four (4) ft, measured from bottom of footing to top of wall). NOTE: Any site plan depicting the placement of any portion of the structure within fifty (50) feet of a property line or not within an established building envelope shall be prepared, stamped, and signed by a licensed surveyor. For structures to be built within a building envelope, provide a copy of the recorded subdivision final plat with the proposed structure located in the building envelope. COVER SHEET: o Project identification. o Project address and/or legal description. o Design specifications to include building use and occupancy classification, type of construction, building height and area calculations, occupant load, and fire sprinkler systems. ARCHITECTURAL PLANS: Please provide the following information on the architectural plans. o Per C.R.S. 12-4-112; Structures designed with an occupant load exceeding ten (10) require Colorado State Licensed Design Professional stamped plans. o Minimum four (4) elevations (N,S,E,W) Floor plans for each level including dimensions and scale noted. Clearly label each room or space (office, storage, mechanical, elevator, etc). o Wall types; clearly labeled and referenced. Identify all fire resistive wall construction. o Construction details for all fire resistive elements referenced on floor plans and cross sections. Include wall, floor/ceiling, roof/ceiling, shaft wall assemblies, and structural frame. Provide the fire resistive listing number referenced on each assembly detail. (ex. UL P123) o Window & door sizes, types, and operation and direction of swing noted on the floor plan. o Specify roof slope/pitch, roof covering, and siding materials. o Energy design specifications/details for R-values, U-factors, and SHGC's per IECC. o Stair and guard details specifying rise, run, height and spaCing. o Accessibility; show compliance with accessibility requirements for all elements of the building per IBC, Chapter 11 and ICC/ANSI A 117.1, ADA, FHA, and UFAS. STRUCTURAL PLANS: Please provide the following information on the structural plans. • Per C.R.S. 12-4-112; Structures designed with an occupant load exceeding ten (10) require Colorado State Licensed Engineer stamped plans. • Engineered foundation design per soils report. Geotechnical report referenced. • Design specifications to include roof and deck snow load, wind and seismic design, frost depth. • Foundation plan showing complete footing and foundation dimensions. • Footing and foundation details specifying reinforcement referenced on plans. • Framing plans for each floor level and roof. All beams, columns, joists, rafters, trusses and all live/dead loads specified. • Framing /connection details referenced on plans. • Pre-manufactured structures require an engineers stamp, signature, and date. MECHANICAL PLANS: Please provide the following information on the mechanical plans. • Per C.R.S. 12-4-112; Structures designed with an occupant load exceeding ten (10) require Colorado State Licensed Engineer stamped plans. • Energy design calculations and details verifying compliance with the 2009 IECC. • Floor plans for each level showing size, location and materials of all ductwork, plenums, return and outside air intake registers. • Size and location of all combustion air ductwork and openings. • Size, type and termination of all gas appliance flues and vents. • Location of all fire and combination smoke/fire dampers. • Equipment schedule for all mechanical equipment (boiler, furnace, exhaust fans, etc). • Commercial kitchen hood location, hood and duct sizes, CFM calculations. PLUMBING PLANS: Please provide the following information on the plumbing plans. • Per C.R.S. 12-4-112; Structures designed with an occupant load exceeding ten (10) require Colorado State Licensed Engineer stamped plans. • Floor plans for each level showing DWV layout and sizing, materials, slope and sewer location. • Water piping materials, length and size of pipe, water meter location, fixture unit demands, location and type of backflow prevention devices. • Gas piping materials, length and size of pipe, gas meter location, and BTU/hour demands. • Additional piping plans for roof/deck drains, condensate, medical gas, etc. • Plumbing fixture schedule for all plumbing equipment. • Commercial kitchen plumbing fixtures, food preparation equipment, grease interceptors, etc. ELECTRICAL PLANS: Please provide the following information on the electrical plans. • Per C.R.S. 12-4-112; Structures designed with an occupant load exceeding ten (10) require Colorado State Licensed Engineer stamped plans. • Floor plans for each level showing location of lighting fixtures, switches, receptacles, emergency exit signs and lighting, and panel location. • Diagram showing service entrance, conduit/wire size, main disconnect size, grounding electrode/conductor size, feeder conduit/wire size, transformers and generators. • Panel schedule showing bus/breaker sizes, circuit description, voltage, phase, amperage, etc. NOTE: If any required information is missing, delays in issuing the permit are to be expected. If determined by the Building Official that additional information is necessary to review the application and/or plans for compliance, the application may be placed on hold until the required information is provided. Work may not proceed without the issuance of a permit. The building department will collect a Plan Review fee at time of application submittal. The Permit Fee, as well as any Septic or Road Impact fees will be collected when the permit is issued. The permit application must be signed by the owner or by a person having written authority from the owner to act as their representative. Owner reserves the right to prohibit operation of any Equipment it reasonably deems to be improperly installed, unsafe or not included in the installation design plan. If any of Tenant's communications Equipment fails because of loss of any electrical power, and the restoration of the electrical power is within the reasonable control of Owner, Owner will use reasonable diligence to restore the electrical power promptly, but will have no claim for damages on account of an interruption in electrical service occasioned thereby or resulting therefrom_ 14. Reloeatlon Right. If determined necessary by Owner to relocate the tower, Owner will have the right to relocate the telecommunications facility of Tenant, or any part thereof, to an alternate tower location ("Relocation Site") on Owne(s property; provided, however, that such relocation will (i) be at Tenant's sole cost and expense, (ii) not unreasonably result in any Interruption of the communications service provided by Tenant on Owner's property, and (Iii) not impair, or in any manner alter, the quality of communications service provided by Tenant on and from Owner's properly. Owner will exercise Its relocation right by delivering written notice to Tenant. In the notice, OWner wilt propose an alternate site on Owner's property to which Tenant may relocate its Equipment. Tenant wilt have Sixty (60) days from the date it receives the notice to evaluate Owner's proposed Relocation Site, during which period Tenant will have the right to conduct tests to determine the technological feasibility of the proposed Relocation Site. Failure to respond in writing within the sixty (60) day period will be deemed an approval. If Tenant disapproves such Relocation Site, then Owner may thereafter propose another Relocation Site by notice to Tenant in the manner set forth above. Tenant's disapproval of a Relocation Site must be reasonable. Tenant will have a period of ninety (90) days after completion of the Relocation Site to relocate its Equipment at Tenant's expense to the Relocation Site. Owner and Tenant hereby agree that the Relocation Site (including the access and utility right-of-way) may be surveyed by a licensed surveyor at the sale cost of Owner, and such survey will then supplement Exhibit A and become a part hereof. 15. Termination by Tenant. Tenant may terminate this Agreement at any time by notice to Owner without further liability if (i) Owner fails to have proper possession of the Site or authority to enter into this Agreement; or (ii) Tenant does not obtain, after making diligent efforts, all permits or other approvals (collectively, "approval") required from any governmental authority or any easements required ANTSITE 6·1 B·OB October 27, 2011 Tenant Site 10: Tenant Sile Name: Rifle from any third party to operate the telecommunications system facility, or if any such approval is canceled, expires, is withdrawn or terminated by such governmental authority or third party following Tenant's diligent efforts to maintain such approval. 16. Default. If the Rent or other amount due hereunder is not paid in accordance with the terms hereof, Tenant will pay interest on the past due amounts at the lesser of (i) the rate of one and onehalf percent (1.5%) per month, or (ii) the maximum interest rate permitted by applicable law. If either party is in default under this Agreement for a period of (a) ten (10) days following receipt of notice from the non-defaulting party with respect to a default which may be cured solely by the payment of money, or (b) thirty (30) days following receipt of notice from the non-defaulting party with respect to a default which may not be cured solely by the payment of money, then, in either event, the non·defaulting party may pursue any remedies available to it against the defaulting party under applicable law, including, but not limited to, the right to terminate this Agreement. Further, Owner may accelorate and declare the entire unpaid Rent for the balance of the existing Term to be immediately due and payable forthwith. If the non-monetary default may not reasonably be cured within a thirty (30) day period, this Agreement may not be terminated if the defaulting party commences action to cure the default within such thirty (30) day period and proceeds with due diligence to fully cure the default. 17. Taxes. Tenant shall pay all taxes, including, without limitation, sales, use and excise taxes, and all fees, assessments and any other cost or expense now or hereafter imposed by any government authority in connection with Tenant's payments to Owner, Tenant's Equipment or Tenant's use of the Site. In addition, Tenant shall pay that portion, if any, of the personal properly taxes or other taxes attributable to Tenant's Equipment. Tenant shall pay as additional rent any increase in real estate taxes levied against the Site and Tenant's Equipment attributable to the Tenant's use and occupancy of the Site. Payment shall be made by Tenant within fifteen (15) days after presentation of receipted bill andlor assessment notice which is the basis for the demand. 18. Indemnity. Owner and Tenant each indemnifies the other against and holds the other hannless from any and all costs (including reasonable attorneys' fees and costs) and claims of liability or loss which arise out of the use andlor occupancy of the Site by the indemnifying party including, without limitation, any damage occurring outside of the Site in connection with Tenant's instaUation of Equipment. This indemnity does not apply to any claims arising from the gross negligence or intentional misconduct of the indemnified party. Hazardous Substances. Owner represents that it has no knowledge of any substance, chemical or waste (collectively, "substanco") on the Site that is identified as hazardous, toxic or dangerous in any applicable federal, state or local law or regulation. Tenant or Owner will not introduce or use any such substance on the Site in violation of any applicable law, or permit any discharge or release of such substance on the Site. 20. Liens. Tenant will not permit any mechanics, materialman's or other liens to stand against the Site for any labor or material furnished by Tenant in connection with work of any character performed on the Site by or at the direction of the Tenant. In the event that any notice of lien will be filed or given, Tenant will, within thirty (30) days after the date of filing cause the same to be released or discharged by either payment, deposit, or bond. Owner will be indemnified by Tenant from and against any losses, damages, costs, expenses, fees or penalties suffered or Incurred by Owner on account of the filing of the claim or Ilen. 21. Casuatty or Condemnation. In the event of any damage, destruction or condemnation of the Site, or any part thereof, not caused by Tenant that renders the Site unusable or inoperable, Owner will have the right, but not the obligation, to provide an alternate location, whether on the same Site or another Site, or to terminato this Agrooment within thirty (30) days after the damage, destruction or condemnation. If Owner does not terminate this Agreement: (i) the Rent payable hereunder will be reduced or abated in proportion to the actual reduction or abatement of use of the Site by Tenant: and (ii) Owner will make any necessary repairs to the Site caused by the damage or destruction and will be entitled to use any and all insurance proceeds to pay for any repairs. In the event Owner has not proceeded to repair, replace or rebuild the Site within Sixty (60) days after the damage or destruction, after giving thirty (30) days written notice and Owner's failure to comply within that time frame, then Tenant may terminate this Agreement. Owner will in no event be liable to Tenant for any damage to or loss of Tenant's Equipment, or loss or damage sustained by reason of any business interruption suffered by reason of any condemnation, act of God, by Tenant's act or omission, or Tenant's violation of any of the terms, covenants or conditions of this Agreement, (unless caused solely by Owner's intentional misconduct or gross negligence). The terms and conditions of this Section 21 shall survive Ihe termination of this Lease. Tenant agrees not to discuss publicly, advertise, nor publish in any newspaper, journal, periodical, magazine, or other form of mass media, the terms or conditions of this Agreement or the underlying Ground Lease. Doing so shall constitute a default under this Agreement immediately. It is agreeable that Tenant will not discuss terms and conditions with any parties not directly involved with this Agreement. 23. Bankruptcy and Insolvency. Owner and Tenant agree that this Agreement constitutes a lease of non·residential real property for the purposes of 11 U.S.C. § 365 (d) (4) or any such successor provision. 24. Miscellaneous. (a) This Agreement applies to and binds the heirs, successors, executors, administrators and assigns of the parties to this Agreement: (b) This Agreement is governed by the laws of the State in which the Site is located; (c) If requested by Tenant, Owner agrees to promptly execute and deliver to Tenant a recordable Memorandum of this Agreement in the form of Exhibit C; (d) This Agreement (including the ExhibiIs) constitutes the entire Agreement between the partIes and supersedes all prior written and verbal agreements, representations, promises or understandings between the parties, particularly related but not limited to Tenant's equipment rights on the tower andlor at the Site. All Equipment must be placed in approved locations only, and Owner must approve any changes before the installation begins. (Must be in place during operation) (b) All EqUipment, including transmitters, duplexers, isolators and multicouplers, must be housed in a metal cabinet or rack mounted. No control stations or inverted IransmiUreceive frequency pairs are allowed on repeater sites. (c) All transmission lines entering the shelter must be 112" HeliaxlWeliflex or better via a wall feedthru plate and must terminate in a properly installed lightning arrestor with an 10 tag on both ends of the line. (d) Solid outer shield cable such as Superllex or HeliaxlWeliflex must be used for all intercabling outside the cabinet. Under no circumstances will the use of foil shielded or braided RF cable (e.g; RGB) be permitted outside the cabinet except for RG·6 quad shield cable installed on satellite receive only systems. (e) All antenna. power and phone cables wi11 be routed and properlv supported to the base station in a neat manner using routes provided for that purpose, Tenant will provide individual Transient (SAD) surge protection to each circuit used. All phone lines will have (SAD) transient surge protection installed. All wiring and installation will be by means of clamping or strapping and in no event will any members or other parts of the tower be drilled, welded, punched or otherwise mutilated or altered. (f) All Tenants are to obtain power from the power panel andlor AC receptacle provided for their specific use. (g) All outside RF equipment cabinets must be grounded to the Site ground system using #2 solid tinned wire with cadweld, silver solder connections, or 2 hole lugs with Burndy type compression fittings. All inside RF equipment cabinels must be grounded to the Site ground system using #2, or #6 green jacketed stranded wire with silver solder connections, or 2 hole lugs with Burndy type compression fillings. (h) All antenna lines will be electrically bonded to the tower at the antenna and at the bottom of the tower using grounding kits installed per manufacturer specifications and all antenna brackets must be preapproved. All antenna lines entering the Site will have COAX center pin lightning protection installed within two feet from the entry port and grounded to master ground bar in the Site ground system. (i) All equipment cabinets ","II be identified with a typed label under plastic on which Ihe Tenant's name, address, 24 hour phone number, call sign, and frequencies will be inscribed, in addition to a copy of Tenant's FCC license. m Monilor speakers will be disabled except when maintenance is being performed. All antenna lines will be tagged within 12 inches of the termination of the feeder cable at both ends, at the entrance to the building, at repeater or base station cabinet, and at the multicoupler/combiner ports. (k) All ferrous metals located outside of the building or on the tower will be either stainless steel or hot dipped galvanized, not plated. Painted towers will require the painting of feedl ines by the Tenant, unless inslalled by Owner, prior to or before completion of Ihe install. All transmission lines are to be secured with factory hoist grips every 150' and secured to the tower or cable ladder with stainless sleel and/or hot dipped galvanized hardware.
