The Board of County Commissioners of Garfield County, Colorado, (Board) received a request for a Land Use Change Permit to allow for Processing and Material Handling for the Parachute Creek Gas Plant Expansion as further described in Exhibit A, Lease Areas, Exhibit B, C, and D, Site Plans. B. The Parachute Creek Gas Plant Expansion is located within a 1,333 acre parcel ofland owned by Williams Production RMT Company LLCIWPX Energy Rocky Mountain, LLC. The ownership of this property is described in a Commonwealth Title Company of Garfield County FileNo. 1201017, dated 1/24/12. C. The subject property is located within unincorporated Garfield County in Resource Lands-Gentle Slopes zone district at 4289 County Road 215. Processing and Material Handling may be permitted in the Resource Lands-Gentle Slopes zone district with Major hnpact Review. E. The Planning Commission opened a public hearing on the 23rd day of May, 2012 for consideration of whether the proposed Major Impact Review for Processing and Material Handling should be approved, approved with conditions, or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. F. The Planning Commission closed the public hearing on the 23rd day of May, 2012 to make a fmal decision. The Planning Commission voted to recommend the Board of County Commissioners approve with conditions the Major Impact Review for Processing and Material Handling. G. The Board of County Commissioners opened a public hearing on the 9th day of July, 2012 for consideration of whether the proposed Land Use Change Permit should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. H. The Board of County Commissioners closed the public hearing on the 9th day of July, 2012 to make a fmal decision. I. The Board of County Commissioners on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That the public hearings before the Planning Commission and Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 2. The proposed use is in the best interest of the health, safety, convenience, order, prosperity, and welfare of the citizens of Garfield County. 3. That the application, if all conditions are met, can be in conformance with the applicable Sections of the Garfield County Unified Land Use Resolution of 2008, as amended. 4. The application is in general conformance with the Garfield County Comprehensive Plan 2030. The forgoing Recitals are incorporated by this reference as part of the resolution. B. The Land Use Change Permit for Processing and Material Handling related to Parachute Creek Gas Plant Expansion is hereby approved subject to compliance with the following conditions: I. That all representations made by the Applicant in the application, and at the public hearings, shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. That the operation of the facility be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 3. Site operations shall not emit heat, glare, radiation, dust, or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. 4. All equipment and structures associated with this permit shall be painted with non- reflective paint in neutral colors to reduce glare and mitigate any visual impacts. 5. All lighting associated with the property shall be directed inward and downward towards the interior of the property. 6. Prior to issuance of the Land Use Change Permit, the Applicant shall obtain all required federal, state, and local permits. This requirement does not include the Construction Pennit from the Air Quality Control Division of Colorado Department of Public Health and Environment (CDPHE) which will be issued prior to commencement of the operation of the facility. The Applicant shall provide a copy of that permit to Garfield County Building and Planning Department upon issuance by CDPHE. 7. The Applicant shall implement wildlife mitigation measures as specified in the William Field Services, Parachute Creek-TXP-1 Project, Section 7-202 Protection of Wildlifo Habitat Areas, Garfield County Unified Land Use Resolution 2008 prepared by WestWater Engineering dated September 2011 and Phil Vaughan Construction Management Inc., Bargath LLC. Parachute Creek Pipeyard Laydown Area, Mitigation Recommendations: Section 7-202 Protection of Wildlife Habitat Areas, Garfield County Unified Land Use Resolution 2008, prepared by WestWater Engineering dated January 2012 as attached as exhibits to the Resolution attached as Exhibit E. 8. The Applicant shall implement Colorado Parks & Wildlife's Best Management Practices as follows: A. Establish policies to protect wildlife (e.g., no poaching, no firearms, no dogs on location, no feeding of wildlife, etc.). 2. Promptly report spills that affect wildlife to the Water Quality Control Division of Colorado Department of Public Health and Environment and Colorado Parks & Wildlife. 3. Store and stage emergency spill response equipment at strategic locations along perennial water courses so that it is available to expedite effective spill response. B. Invasive/Non-Native Vegetation Control I. Continue control programs for the life of the well field (applicable to the Gas Plant). C. Restoration, Reclamation and Abandonment I. Seed a. Use appropriately diverse reclamation seed mixes that mirror an appropriate reference area for the site being reclaimed (see also species- specific recommendations). b. Emphasize bunchgrass over sod-forming grasses in seed mixes in order to provide more effective wildlife cover and to facilitate forb and · shrub establishment. c. Plan for reclamation failure and be. prepared to repeat seeding as necessary to meet vegetation cover, composition, and diversity standards. 2. Vegetation Cover Standard a. Establish vegetation with total perennial non-invasive plant cover of at least eighty (80) percent of pre-disturbance or reference area levels. 3. Establishing Reclaimed Areas a. Apply certified weed free mulch and crimp or tacify to remain in place to reclaim areas for seed preservation and moisture retention. b. Utilize staked soil retention blankets for erosion control and reclamation oflarge surface areas with 3: 1 or steeper slopes. Avoid use of plastic blanket materials, known to cause mortality of snakes. c. Control weeds in areas surrounding reclamation areas in order to reduce weed competition. d. Monitoring 1. Conduct necessary reclamation and invasive plant monitoring. E. Deer and Elk 1. Avoid aggressive non-native grasses and shrubs in mule deer and elk habitat restoration. 2. Reclaim mule deer and elk habitats with native shrubs, grasses, and forbs appropriate to the ecological site disturbed. F. Black Bear 1. Initiate a food and waste/refuse management program that uses bear-proof food storage containers and trash receptacles. 2. Report bear conflicts immediately to CPW. 9. Prior to construction, the Applicant shall provide the Garfield County Planning Department for their review, evidence demonstrating that the Applicant requested an extension to their existing stormwater permits for the TXP-1 expansion and laydown/employee parking areas from Colorado Department of Public Health and Environment (CDPHE). Once CDPHE issues these permits copies shall be provided to Garfield County Planning Department. I 0. Erosion control measures shall be in place at the laydown yard/employee parking area prior to any construction commencing. 11. The Property Owner and Operator acknowledge that the County has the following performance standards, and failure to comply with such standards could lead to revocation of the Land Use Change Permit: A. All fabrication, service and repair operations shall be conducted within an enclosed building or obscured by a fence, natural topography or landscaping; B. All operations involving loading and unloading of vehicles shall be conducted on private property and shall not be conducted on a public right-of-way; C. All industrial wastes shall be disposed of in a manner consistent with statutes and requirements of CDPHE; D. Every use shall be operated so that the ground vibration inherently and recurrently generated is not perceptible without instruments at any point of any boundary line of the property; and, E. If project construction is not completed prior to the next nesting season (May 20 12), the site should be re-inventoried by qualified biologists. The main area of concern would be the cottonwood trees west of the project site. If any raptors are found behaving in a manner consistent with nesting, every effort should be made to apply timing limitation and buffer distance stipulations (Table 5). WWE recommends temporal and spatial restrictions for activities near active nests based on BLM stipulations (BLM 1997), Colorado Division of Wildlife (CDOW) recommendations (Craig 2002 and Klute 2008) and literature review of nesting season timing. for raptors in the Roan Plateau region (Andrews and Righter 1992, Kingery 1998, Poole 2005). a e . All towers and similar structures have the potential to kill birds. Light appears to be a key attractant for night-migrating songbirds, especially on nights with poor visibility, low cloud ceilings, heavy fog, or various forms of precipitation associated with either passing or stationary cold fronts (Tordoff and Mengel 1956, Ballet a!. 1995). The high visibility of the flare and not being located near wetlands reduces the chances for bird mortality. The lack of vegetation surrounding the structure reduces the chances for locally nesting birds to interact with the flare. Several raptor nests have been found in the general project area however none have been found within 0.25 miles of the project area. It is likely that mptors forage and hunt near the project area. The conspicuous location and the high visibility of the flare structore greatly reduce the chances of raptor mortality from collisions. Based on these factors presented above, it is not expected that bird mortality will be a significant issue with the proposed TXP 1 project. American Elk and Mule Deer The plan for construction of the TXPl project in an area where natural gas facilities already exist will reduce habitat fragmentation and is a good mitigation technique. Implementation of an aggressive noxious weed management plan would improve the existing condition of the area surrounding the proposed development. Elimination of annual weedy species, whitetop, and chicory would allow for increased grass production for use by wildlife. Any livestock fencing (barbed wire) should be constructed to minimally affect elk aod mule deer movements. The top stand should be smooth wire. The Colorado Division of Wildlife has published guidelines for construction of fencing that reduces impacts to mule deer aod elk (CDOW http: wildlife.state.co.us). Following "wildlife friendly" fencing standards reduces the chance of mortality from animals becoming tangled in fencing and improves the opportunity for less restrictive movements throughout the area. Black Bear Black Bear will likely be foraging along Parachute Creek near the project area during the fall particularly when berries and oak brush acorns ripen. Construction personnel at the tower site may be unfamiliar with wildlife in the area and should be informed of the potential for bear interactions. Personnel should not feed bears at any time. Bear should not be approached if encountered in the project area. All garbage and any food items should be removed from the site on a daily basis .. However, if any brush clearing is necessary, it should be done outside of the nesting season, which is generally considered to occur between May 15 and July 31 for most species in this area. June I to July 15 is the peak period when most incubation and brood rearing takes place. If brush clearing occurs prior to May 15, most affected birds will relocate to alternate nesting sites. After mid-to-late July, most fledging has occurred and brush/tree clearing impacts would be minimized. Small Mammals, Amphibians, and Reptiles There are no seasonal restrictions or special requirements for development related to these species. PRESERVATION OF NATIVE VEGETATION The best method to mitigate loss of wildlife habitat is to increase the availability of native forage in the form of grasses and shrubs. The small amount of habitat lost to the project will be minor in relation to the large expanse of the wildlife habitat in the surrounding area. Native grasses would provide the greatest benefit for wildlife. The development and application of an integrated vegetation and noxious weed management and implementation of the reclamation plan in areas of disturbance would provide the basis for appropriate mitigation. Treatment and Control of Noxious Weed Infestations In addition to reclamation implemented within the disturbed area of the project site, the highest priority for noxious weed management (eradication) is whitetop, chicory, and tamarisk within 100 feet of the project site. Noxious weeds aggressively compete with native vegetation. Most have come from Europe or Asia, either accidentally or as ornamentals that have escaped. Once established they tend to spread quickly because the insects, diseases, and animals that normally control them are absent. Prevention is especially valuable in the case of noxious weed management. Noxious weeds are spread by man, animals, water, and wind. Prime locations for the establishment of noxious weeds include roadsides, construction sites, wetlands, riparian corridors, and areas that are overused by animals or humans. Subsequent to soil disturbances, vegetation communities can be susceptible to infestations of invasive or exotic weed species. Vegetation removal and soil disturbance during construction can create optimal conditions for the establishment of invasive, non-native species. Construction equipment traveling from weed- infested areas into weed-free areas could disperse noxious or invasive weed seeds and propagates, resulting in the establishment of these weeds in previously weed-free areas. Several simple practices should be employed to prevent most weed infestations. The main area of concern would be the riparian area along Parachute Creek; due to low tree height and an open canopy, the pinyon-juniper woodlands west of the project provide poor raptor nesting habitat. Implementation of an aggressive noxious weed management plan would improve the existing condition of the area surrounding the proposed development. Elimination of annual weedy species and noxious weeds would allow for increased production of desirable plants for use by wildlife. If it is later determined that the laydown yard is no longer necessary, implementation of a simple reclamation and revegetation plan would benefit wildlife by establishing desirable plants in the disturbed area. Wildlife should be considered before any fencing is designed or built. Following wildlife friendly fencing standards reduces the costs of repairing fences damaged by wildlife, reduces the chance of mortality from animals becoming entangled in the fence, and allows for less restricted movements throughout an area. The CPW has published the following general guidelines for fence construction that reduces impacts to wildlife (Hanophy 2009): • Place fence wires on the side of the fence posts facing livestock (outside of posts surrounding the laydown yard); • Use smooth wire on the top and bottom strands; • The highest strand should be 42-inches or less from the ground on level ground (slopes increase the effective height of a fence); • Allow at least 12-inches between top two strands; • Allow at least 16-inches from bottom strand to the ground; • Place posts no closer than 16-foot intervals; • In areas favored for crossing by wildlife, consider engineered crossing points such as lowered top strands, higher bottom strands, gates, drop-downs, removable fence sections, etc.; • Consider a rail, high-visibility wire, flagging, or other visual marker on the top strand of new fencing structures until animals become accustomed to the new fence.
