County Manager when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 2011-49 A RESOLUTION CONCERNED WITH THE APPROVAL OF A LAND USE CHANGE PERMIT, FOR A MAJOR IMPACT REVIEW APPROVAL OF A SOLAR POWER GENERATING SYSTEM LOCATED AT 5454A COUNTY ROAD 346, ON PROPERTY OWNED BY EAGLE SPRINGS ORGANIC LLC AND ORGANIC GROWER LLC, . GARFIELD COUNTY (FILE NO. MIP A-6775) PARCEL NUMBERS# 2179-173-00-732, #2179-174-00-731, #2179-172-00-710, #2179-172-00- 687, and #2179-174-00-686 Recitals A. The Board of County Commissioners of Garfield County, Colorado, received an application for a Land Use Change Permit for a Major Impact Review for a Solar Power Generating System and related support infrastructure on the Eagle Springs Organic LLC and Organic Grower LLC property. · B. The site is located on an approximately 306 acre parcel and the proposal is for construction of approximately 77.7 acres of solar panels. The site is located at 5454A County Road 346 with an alternate entrance to the property off of County Road 315. The site is approximately 3 miles southwest of the Town of Silt and 2.5 miles east of the City of Rifle. l 1111 fro~. The Solar Power Generating System is located on properties within Sections 17, 18, and 20, Township 6 South, Range 92 West of the P.M. and further described in Exhibit A. D. The subject property is contained within the Rural Zone District and a Land Use Change Permit for a Solar Power Generating System requires approval through a Major Impact Review Process by Garfield County. E. The Board of County Commissioners is authorized to approve, deny or approve with conditions a Land Use Change Permit for a Solar Power Generating System, pursuant to Sections 1~301 and 4-106 of the Garfield County Unified Land Use Resolution of 2008, as amended. F. The Plarming Commission considered this request at a public hearing held on August 10, 2011 at which time the Commission recommended approval with conditions to the Board of County Commissioners. G. The Board of County Commissioners opened a public hearing on the 6th day of September upon the question ofwhether the Land Use Change Permit application, MlPA-6775, should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the application. H. The Board of County Commissioners closed the public hearing on the 6th day of September, 2011 to make a final decision. I. The Board of County Commissioners on the basis of substantial competent evidence produced at the aforementioned hearing has made the following determinations of fact: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted or could be . submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the Land Use Change Permit for a Solar Power Generating System is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. County, Colorado, that: A. The forgoing Recitals are incorporated by this reference as part of the resolution . . B. The Land Use Change Permit, MIPA-6775, to allow a Solar Power Generating System consisting of approximately 77.7 acres of solar panels and related support facilities and infrastructure, as depicted on Exhibit B, is hereby approved subject to compliance with the following conditions: 1. That all representations made by the Applicant in the application, and at the public hearing before the Board of County Commissioners shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. The operation of this facility and any future amendments shall be done in accordance with all applicable Federal, State and Local regulations governing the operation of this type of facility including but not limited to the FAA approvals and notifications. 3. The Applicant shall maintain compliance with the provisions of Section 7-819 of the Unified Land Use Resolution of2008 as amended including but not limited to: site rehabilitation, operations, repair and maintenance hours, and lighting. 4. The Applicant shall comply with the recommendations of the County Vegetation Manager in regard to weed management including possible annual site visits to assess the site and ongoing treatment for county and state listed noxious weeds. 5. Reclamation of the site shall include reseeding with an appropriate seed mix approved by the County Vegetation Manager. Reseeding will include any areas disturbed for solar installations, utility extensions, and irrigation ditch piping. Reclamation shall be completed after construction and prior to historical periods of adequate moisture. Security in an amount to be established by the County Vegetation Manager shall be provided in a form acceptable to the Board of County Commissioners. Please quantify the area in terms of acres, to be disturbed and subsequently reseeded. The amount of the security may be adjusted based on the timing and status of reclamation for each phase. Security or bonding for reclamation may be provided on a phase by phase basis. Construction access shall be limited to the Mamm Creek Rd. (County Road 315) access consistent with the Applicant's Traffic Study. During the construction phase the Applicant shall provide portable toilets, storm-water/soil erosion management as needed for any site disturbance, and shall provide for secure storage and/or daily removal of any trash or refuse from the site. 7. The solar arrays and electrical vaults shall maintain a minimum setback of 25 ft. from all property lines consistent with standard front/rear setback requirements for the Rural Zone district. 8. The Applicant shall comply with the Fugitive Dust Control Plan as submitted and shall obtain the required APEN (Air Pollutant Emission Notice)-Application for Construction Permit from the CDPHE prior to any further construction activity. 9. To protect the safe aerial operations that occur at the Garfield County Regional Airport the owtJ.ers and operators of this facility shall at all times fully comply with the FAA Aeronautical Study No. 2010-ANM-2283-0E and/or future FAA aeronautical studies including, but not limited to, approved conditions for construction, repair, maintenance and/or expansion of this facility. 10. The Applicant shall comply with the requests from the Burning Mountain Fire Protection District, contained in the Fire District letter dated July 25, 2011 including addressing and emergency response training.
